Question regarding husband's children from previous marriage

Hi all,

I'm new to all of this and have a quick question. My US citizen husband has two young children whom live with their mother - she has sole custody. Our application will not include the children migrating to Australia and they aren't classed as solely dependant on my husband; so do we still need to bother enclosing their birth certificates? I read somewhere that you need to provide birth certificates of ALL children but I'm not sure if they just mean children related to the application or your children in general.

This is for a partner visa (already married).

We had to provide certified birth certificates for the children from a previous marriage even though they are 21yo and 25yo and neither are included on the 309 visa application

This is also confusing me...my missus has 3 adult kids that were noted on application but not listed on visa as applicants and we were told no need to provide certificates of any sort or this need to do a medical as well (Issues that have been raised here on other threads)

Ha Ha How do they work out what they want??? its up to the co I guess.
My wife had to provide birth certificates for her adult children for a tourist visa early last year.

If this helps you guys, ANY child under the age of 18years from your marriage or a previous marriage/ relationship has to be included, my son is 17 my daughter is 27 only my sons details had to be submitted along with his medical, neither one of them are here or included in the visa, when I questioned why its because they said that whilst my son is not coming he is still under the age of 18. My daughters details were,nt even asked for.

So the children under 18, even if they aren't included on the application need to still have a medical done? I'm totally confused now.

Yes they can and sometimes do ask for medicals for children that are not included on the visa application.

That may be an issue for us because my husband's ex wife has sole custody of their children, we wouldn't even have access to them under those circumstances to have medicals done.
