anyone know wat the story is with a criminal record and applying for visas???

my husband and I are irish and we are in australia on a years working visa and my husband has an eight year old conviction for possession of a small amount of class a drug in ireland. We are thinking of applying for residency. will this affect our application?????????

Sorry, I don't for certain and it could well be left up to the discretion of immigration. I presume that you declared it when you applied for your working visa. If they still approved your visa, it means they didn't consider it serious enough at the time to reject your application.

When you have a look within the eligibility section for any visa and see the reference to good character or police check etc. just follow the links through and you'll eventually come to a description of what type of crime and/or sentence will close the door.
. Anything over a 12 months custodial sentence could prevent approvals but it is usually more violent crimes that they look at, stuff which exhibits behaviour that could be seen as a danger to Australian public.

. If there was no violence and seeing it was eight years ago, even if sentence was over 12 months you may not be refused.

. Another thing though and if it's the WHV you are here on, that will have some restrictions depending on what type of visa you think you can apply for, ie. if applying for a 175/176 there'll be no bridging visa issued while another visa application gets processed [ a 176 would be quicker but requires state nomination, details on state links under eligibility].

. There's also 457 sponsored visas but I'd reckon with global economic/employment conditions they could be hard to come by.

If it is a WHV you're currently on you may be aware that if you're young enough you could do some specific regional work or WWOOF Australia wwoofing and be able to apply for a second WHV - at least give you more time to get organised for another tyoe of visa.
Supposed to be good money that can be earnt from about now on up Broome way in pearling industry too.
