Applying for 190 after being on 457 with different occupation code

Hi,

I have applied for Victorian state nomination (application still pending). During this time have also secured a job and on a company sponsorship and have since received our 457 visa.

The outcome of the Victorian state nomination is still pending due a backlog in the processing of ICT applications
.
My successful skills assessment and the application for the 190 visa (state sponsorship) is under ANZSCO code 135112 (ICT Project Manager). The 457 Visa was granted under ANZSCO code 261112 Systems Analyst.

We are expecting the approval of the state sponsorship fairly soon and would therefore like to apply for our 190 visa as soon as possible, in order to enjoy the benefits of permanent residency. My question is thus as follow:

Would it be an issue to apply for the 190 visa under code 135112 (for which I will have a successful state sponsorship nomination and skills assessment), even though the 457 visa my company applied for and which was granted is under code 261112.

We have not arrived in Australia yet, but I cannot think this will influence the outcome.

Should not be a problem. There doesn't have to be a "close" relationship between your 190 and 457 occupations. (They are pretty closely related anyway)

Hi Jeremy,
I saw your replies here and thought that you could suggest me as well.
I'm on Security specialist job code on my 457 visa and willing to apply for 189 PR visa under Software Engineer code. I'm pretty sure that I'll get the letters from my organisation for ACS assessment. So the only doubt is that how DIBP will take it? Will there be any issue while doing so?
Also, does DIBP need us to show my current 457 visa at any point of application?
Thanks and I hope you can help me with this. Appreciate a quick response.

Different Occupation on 457 and 189/190

Hi,

With all the changes happening now to the visa/migration conditions, I have a situation where I am on a 457 visa under ANZSCO code 313112 (ICT Customer Support Officer) which is in the combined list and I am planning to apply under ANZSCO code 261111 (ICT Business Analyst) on 189/190 Visa. Will this be a problem since the occupation is not the same?

Hi,

I am in the same boat. How did you go about your application.

My occupation under 457 was 313112 (ICT Customer Support officer) which was incorrectly done by my employer, may be they wanted to pay me less money that's why. Now, I have got the positive assessment from ACS under 261313 Software Engineer with 2 years deduction.

Have submitted EOI for 189 at 65 points and 190 at 70 points. To be on the safer side, I haven't claimed the points for 1 year of AU experience because of different occupation under 457. I am currently in Melbourne only on a 457 visa.

Not sure if this would this create any problem for my application.

Can some body please help me on this. Would this be ok whatever I have done or is there any valid concern that would come into play.

even i have a similar situation here.

my previous 457 visa was on systems analyst 261112 which was cancelled last year by my employer. a second 457 visa has been applied by my employer this year lodged on 24th april 2017 on ICT support engineer.

even i have applied for PR as Computer Network and Systems Engineer (263111) after a positive skills assessment from ACS. I have applied for a State Sponsored PR Visa couple of weeks back and I am able to get 60 Points.

I havent got my 457 approval yet and i am just waiting for it. RFI has been requested by DIBP on October end which has been submitted by my Corporate Visa Cell.

Do i have chances for getting my PR application Getting picked by NSW ????
