Visa Denial

Hi All,

My 189 visa application was denied last week. The reason being an ignorant mistake I have made. I got the skill assessment document from ACS on 14 Feb and I got the invite on 18th Feb. Since a mistake was identified , ACS had amended the document and provided me a new doc. THe reference number was the same on both the docs. But when I submitted all the requested docs, I have given only the latest document since the reference number on the doc was the same.

The visa was rejected for the reason that the evidence was not provided for the Skill Assessment document before the invitation. I was really ignorant on this and has caused all this mess.

I have now provided all the evidence for the same. I would like to know whether a situation is there by which the decision taken by DIAC will be reviewed?

The date on which the Skill assessment was amended was on 19th Feb just after the invitation.

Can anyone help in this regard

Pre application (not invitation) did you have a positive assessment?

The assessment was positive on 14th before the invitation. However noticed that the employment history was not recorded correctly and hence amended on 19th with the same refernce number. The issue what DIAC is telling is that I should have submitted the one on 14th also , Bad Luck!!

What immigration is telling you is true. The Invitation information and decision information is locked, and if anything is not exactly the same, the visa must be refused. This is indeed bad luck, and you have no right to review. You will have to repeat the process.

As I advise all clients, after you receive an invitation, you absolutely must travel to Australia as a tourist, and then make your application. The 8503 condition can be waived in Australia if making an application for a GSM visa, and also, if lodged in Australia, you would have review rights.

Next, after invitation, make the app in Australia.

Thanks Chris. Can I apply immediately ..mean to say ..submit a new EOI?

Without seeing the refusal letter , I can't provide any advice on when you can make another app. You may be able to apply immediately. However, in cases where the decision maker feels the applicant has provided false documents, there may be a ban on applying again. I imagine it should be ok. If in doubt contact immigration, or your CO directly, or have someone take a look at the refusal closer.

If there is any ban , then it should have been in that denial record .I couldnt see anything l,ike that.
