Unhappy Visa being withdrawn due to job change. Any help appreciated.

Hi,

I applied for an ENS transition visa (186) in August and just received a case officer this week. The case officer contacted my employer today to advise that the application needed to be withdrawn as the ANZSCO code on the PR application did not match the one on the 457.

The positions were, ICT - Customer Support Officer, and ICT - Account Manager.

While I understand my employer should have put the same job on the application my position had changed slightly due to promotions which is why the new position was put in the application (the company also contacted the company lawyers about the position change, who were due to contact immigration with this information).

The case officer told me I do not have many options and that I have to withdraw my application and may not be able to put in another application.

Can anyone advise on possible options here. The positions in my companies eyes are very similar but the ANZSCO codes are completely different (different first four numbers is the important part I am told). Does anyone have any experience of something similar, if so is there any point in pursuing the fact the positions are essentially the same, or would it be possible for them to review the actual application and change the nominated position to the same as the 457?

I find it hard to believe that after 9 months of hearing nothing and being advised that we have to wait for a case officer that one part (albeit an important part) of the application will cause the whole application to be rejected and not possible to appeal/review.

Immigration are saying it's black and white and that the legislation is clear but hoping there is some way to clear this up. I have been in the country 4 1/2 years, in the job 3 years and have had a 457 visa for 2 years and 9 months.

Any help appreciated here.

In my opinion, this is an unusual enough issue (and a precarious issue, visa-wise) that you'd be much better off seeking the assistance of a MARA-registered migration agent.

I will be seeking assistance from a migration agent, but so far from speaking to them over the phone it seems like just tough luck.

Hi,

Have you had any more luck since posting your message?

I'm in a similar situation where the role I selected in my application, although similar doesn't match the anzsco role my employer selected for the pr visa.

I've been told I loose my 3000 dollars and have to cancel application or go to tribunal.

This is ridiculous, a simple mistake on the form is costing soooo much money. In all other instances I've referred to the same role as my employer in the application just this one drop down I got wrong.
