Prov Spousal Visa - Separated @ 2 year Mark

Hello all,

I've been on a provisional spousal visa (309) and passed the 2 year mark several months ago.

I have been separated from my wife for over 6 months, and we decided to proceed with divorce (right at the 2 year mark).

I assume they know (as they knew we were separated but were also planning to get back together), but am not sure what to do.

Should I call them? Any tips / advice on my options (eg, chances of success if I apply for perm residency, etc.)?

You're legally required to notify them if the relationship breaks down. So yes, you need to call them right away. Unfortunately your chances for PR are tired to your relationship continuing, so I don't think your chances are good. You could always ask a migration agent just to be sure there's nothing you're missing.

Applied: End of April 2014.
Visa Granted: Early July 2014.
Visa #3: 801 (PR)
Eligibility Date: End of April 2016 (Applied a month prior).
PR Granted: Early April 2017.
