sub class 189 queries

Dear Madam/Sir,

I am fascinated to apply for Australian Immigration as I am impressed by the country's outlook, culture etc.

I have two queries which I need you to address before I start the process

I have a child who is from my previous marriage and want to include him in my application process for sub class 189. So what will be the scenario in this case. Can he be included in first instance. If for any reason he cannot be included now, how difficult will it be to apply for him later on.

Second and last query is, Can I be eligible to apply for my parents along with my application and what will be the terms and conditions if I am eligible?

Hi Mirkhan:

Thanks for the post. You can include your child as long as all those who have parental responsibility (ie, control where the child can live, travel, etc) agree and provide written permission that the child can be included in the visa application. Much easier to include the child in the visa application vs. arranging for another type of visa later on (long waits). You have to disclose the child anyway on the application even if the child won't be included in the application to get a visa, and the child must pass a health exam even if not being included for a visa.

Re: parents, can't generally be included as dependents. You may want to investigate the different types of parent visas available for that - unfortunately the Parent visa has a 14+ year backlog currently - the better option if you parents are not old enough to qualify for the Aged parent options would be the Contributory Parent visa - it has a very high visa application charge (over $42,000) but these are generally processed in a year or so.

Hope this helps - please note that there are many requirements for the subclass 189 visa and for the skills assessment that is required - you should review these carefully.

Thanks! Some clarifications on child custody

Mr. Mark,

Many thanks of the day to you! It was so good to read the replies.

I have some clarification about my child, I hope you will help me little more on this.

If I do not get the child custody and submit the application with his details only, will it be a problem in anyway at the time of health exam and when the visa will be granted on my application.

On the other hand if that's not the case and if I get the Visa excluding my child, on which visa I can apply later on for my child if circumstances change and approximately how many years are required.

I have calculated and eligible with needed points for sub class 189.

Hi Mir -

If the child is not included in the application, the primary requirement then is that the child pass a health exam which is required even if the child is not applying for a visa with you.

As for a visa after you are granted yours, that would likely be a Child visa, see:

What will the best way to proceed?

I was wondering whether mentioning the details about child from first marriage and including him in the application are two different things. If they are two different things then what I understand is that for applying which is the second part (after disclosing) I need the permission from his mother which I do not have presently. And at the time I send my application if I do not have legal permission I only need to disclose the child and should not apply for him, Am I right? But whatever be the situation (whether I have permission or not or whether I am including him or not in application) as I have mentioned (disclosed) about him in my application in all cases I need to provide his health check.

The other option which I will have is to wait for the right time to apply my son on sub class 101 which has its own descriptions. This son is from first marriage which led to divorce.

What are the success rates of applying for the child who is from previous marriage (Divorce cases) at DIAC?
