We submitted the complaint on Saturday the 9th of December, on Monday the 11th we received the standard acknowledgment letter, then a day later on the 12th it was approved.

Yes i'm well aware of what the website states, we were just sick of waiting so we though what the heck why not try. I don't know if the complaint helped or if it was the fact we were almost in the 75% of application being approved in 16 months.

We obviously complained about the wait times, but specifically stated the fact that we had it in writing from DIBP that wait times were only 6-8 months at time of application. The main reason for the complaint though was the fact that due to such long wait times my wife was unable to find work here in Australia, she is a marine biologist and most positions are government based so naturally they require PR or citizenship. She ended up taking a 12 month contract in the Maldives (Tough life for some huh), and due to this fact we are living apart.

I want to share a good news to everyone
My partner's 801 visa has been granted few days ago on Friday, so we are sooooo happy and I wanna say thank you to all who have been supportive and answered any queries we had esp Mish!
We just celebrated yesterday and we still haven't sunk in yet!

Since we have been granted, we want to ask a few questions that we have in mind

Given she has been granted on 14th Dec 2017,
1) I assume she is now a PR starting on the same date?
2) As I am aware that the new rule for applying citizenship this year, you need to stay here in Australia for 4 years (instead of the old 1 year) and you can be overseas for 12 months max out of the 5 tears or otherwise she needs to apply for the Return Resident Visa?
3) Does she need to do anything now? Like apply the FULL medicare or need to transfer her oversea driver license to Australian driver license since she is PR now? Or any other additional things?

PS: In case people want to know how we have progressed
Dec 2014 - Applied 820
July 2016 - Granted
Dec 2016 - Applied 801
Dec 2017 - Granted

We have not been contacted from CO at all apart from 820 period where we were phoned request to submit police check record and Form 88. Other than that, we had no contact and only received email notification status until the final outcome

Congrats.

1/ She is PR since the date it is granted.

2/ The new rules did not go through, so the old rules still apply - 4 years with 1 year PR. However, they did mention that they would be effective 1 July 2018 but that all comes down to if it gets voted or not, so you should keep an eye on it. Currently, it is what is was previously so no more than 12 months out of Australia within 3 months in the year before applying for citizenship.

3/ No. The Medicare green card will come automatically. The drivers licenses could have been done when a TR anyway. Each state is differently, so I will speak about QLD as I know the QLD rules. For QLD they need to get a QLD drivers license within 3 months of getting their 801. IF they don't then their authority to drive on Australian roads is revoked. If it takes longer than 3 months to get their license then they need to get a learners permit in order to drive on Australian roads. I am unsure what country they are from but some you can get a QLD license in replace, others you need to sit a written and driving test.

1) Do they count the processing time (16-22months) from the first submission date (13 July 2016) or from when you have done all paperwork and hit the "information provided" button on your immi account (5 Aug 2017)?

2) If the 16-22 months are counted from eligibility date (7/8/16) it should mean that I could receive it between December 2017 and June 2018?

3) Niamh has close to the same timeframe but has received hers already. Should I send a complaint as well and if so, how does one do that the correct way?

Hi All!

Long story short, I first applied my visa on 4 Dec 2014 and the 820 was granted on 3 Mar 2016.

Eligibility date for 801 visa was 4 Dec 2016 and application was submitted on 27 Dec 16.

A few days ago, an immigration officer sent me an email to request further additional evidence on cohabitation (I received a very similar letter last time round for additional evidence, but every time when a letter like this is in my inbox it just freaks me out...it gives a feeling where the case officer doesn't believe in your relationship...anyways..)

So after a frenzy of gathering what I could get my hands on, here is what I have included all together, hoping someone can tell me if I have missed out some important documents:

1. Statutory Declaration from Sponsor
2. Statutory Declaration from Applicant
3. Form 888 from friends x4
4. Electricity bills showing both of our names (for full year of 2017, my partner didn't include my name in most of the bills...)
5. Credit card bills showing me being under his main account
6. Miscellaneous letters from different organisations showing we have the same address (e.g. insurance companies, banks, ABS etc.)
7. updated rental agreement
8. letters from our leasing agent
9. screenshot of my recurring transfer set up to my partner for rent and monthly expenses (not the specific transfer, just the summary, as I cannot split them out from my monthly statement)
10. Joint apartment purchase contract (re-upload, previously submitted fr 820)
11. Relationship certificate (re-upload, previously submitted for 820)
12. Whatsapp chat history
13. Travel - flight tickets, hotel reservation for past and up coming holidays (where available, in certain holidays we stayed with family so there weren't hotel reservations)
14.. Photos - selected photos of different occasions, mainly at friends' weddings, our birthdays or when my parents visited
15. Invitations - invitations to weddings
16. Screenshot showing being each other's superannuation's beneficiaries
17. screenshot, letter and insurance card showing sponsor is listed as my spouse under my corporate insurance plan
18.Tax declaration showing we declare each other as spouses

Please someone give me some advice Many thanks in advance!!

Can u please tell me what your status was before granted your PR?
Mine is still sitting under received.

I submitted mine on 11.04.2017 for 801
I applied on 11.04.2015 for 820

In your stat decs did you talk about those 4/5 questions? ie- describe financial commitments,describe nature of household etc?

Do you have a joint bank account where you can show everyday transactions? (i forgot to add a newer one but had one in the 820)

For tax purposes I considered myself a PR because I stayed in the same place for more than 6 months. Since the 801 grant, I am considered a PR in general.
