No, your sponsor already applied and got approved for sponsorship when you first applied for the 820/801

Your partner does have to complete the partner stat dec and attach it to your documents. If they haven't filled it out already you can find it here https://www.homeaffairs.gov.au/Visas...ec_sponsor.pdf

Hi everyone,

I would like to know how long is the average waiting time.

I sent my application for 801 in january 2017 and still waiting...

Anyone in similar timeframe?

This is actually the question I came here to ask, so thanks for that!

I do have one other query though. Obviously my wife completed a sponsorship application online for both my PMV and the first stage of my 820/801 application, and I can see the status of both of these sponsorship applications as being "Submitted", whereas mine show as "Finalised". Now, clearly I was granted a PMV and my 820, so I don't think I need to be worried, but just to put my mind at ease, her previous sponsorship applications showing as "Submitted" isn't a problem, right?

And we DEFINITELY don't have to lodge a sponsorship application in her name for the 801 visa, because she's already sponsored the first stage?

Thanks in advance for any info you can provide!

Anyone on same boat??? Was eligible for 801 on 15 march 2017 but my agent was careless and didnt had any clue whats going on. So i applied myself on 05/11/17.
Application shows further assesment
Had a contact with immigration call centre and was advised that 801 processing time counts when you submit the application/documents and NOT ON ELIGIBLE DATE.

That’s very interesting what the officer said so which means we’d better apply whenever we are allowed to apply...

Don’t get it! Doesn’t sound logical and seems no rules regarding the waiting queue..

I’d better forget about it and will get it! Simple and peaceful

Call again and speak to someone different and you're likely to get a completely different answer. They've been known to give a lot of different answers.

In fact, what you've been told completely contradicts the immigration website which clearly states: "Processing time for subclass 801 Partner (permanent) visa is from date of eligibility (2 years after the 820/801 application is lodged) to finalisation."

Not to mention that answer you were given makes no sense. Otherwise people could just NOT submit documents and no one would look at the case. Essentially allowing them to remain on an 820 indefinitely. Which we know isn't the case as people who have conveniently forgotten to apply had previously been contacted by immigration for the documents to be submitted. Though that was before the changes where now they can just issue a refusal and not request documents.

801 checklist for sponsors is available on the immigratipn website. Says only a stat dec form, the particular one required is linked there as well. So no, no 40SP for sponsor as you did it in stage 1.
