I also found that the IMMI department only interest one year before we have submitted the application, not from the date we were living together actually. I am very regretful that I did not put in my application in 2014. now I have to waiting even longer time. sad

I read info on this forum before to prepape 820/801 app myself. I would like to share my story to say thank you. My 801 was approved 9 days after the eligible date.
I have been living in Australia for nearly 7 years on another visa.
April 2016: lodged 820 online.
I completed a police check and health examination in April 2016.
Sep 2017: CO contacted for another police check because the previous one expired. CO said I needed to provide the police check in 8 days, otherwise I had to do the health examination again because this would expire in 8 days. I thought I wish I have done another police check earlier, so I would not be in this situation. This is an experience to everyone who has provided a police check early.
Sep 2017: Police check came late (after 8 days). I was requested to do another health examination. I decided not to do the examination at that time because I was pregnant. I donít want risks because of Xray.
Feb 2018: I completed a health examination after giving birth to our child.
4 days later: 820 was approved. An officer called me right before the grant notification went through. She said they could not approve 801 for me right away because it had not been 2 years yet (Our relationship is more than 3 years and we have a child together). She said I would be eligible for 801 in April 2018. I asked whether I should email the 801 processing centre by then. She said I could try.
Mar 2018: I uploaded documents for 801.
Mid April: Eligible for 801
I forgot to email the centre until 8 days after the eligible date because of being busy looking after a newborn baby.
1 day after my email: My 801 was approved. So it means my 801 was approved 9 days after the eligible date.
Thank you everyone on this forum. I am sorry if I canít reply your questions if any because I am quite busy at the moment.

Jenny68 noted that she was able to be considered for being in a long-term relationship with her partner, which means that her 801 would be granted immediately after her 820 (ie she was in a relationship with her partner for 3+ years and/or was in a relationship with her partner for 2+ years and they had a child together).

I'm not 100% sure, but I think the applicant needs to request to be considered long term, which is why she emailed the immigration department. I wasn't under the impression the applicant had to wait until after the 801 eligibility date for it to be granted when under consideration for being long term, but looking at Jenny68's time line it seems that was the case for her.

Happy to announce my 801 was granted today! Almost exactly 1 year after I applied. Was not asked for additional info, although I did update with recent photos and evidence of travel last month. Good luck to everyone still waiting

I wrote whether it is possible for my visa to be processed now?
I contacted the Department through https://www.homeaffairs.gov.au/about...s-enquiry-form

Yes, I think my 801 was approved because of a long term relationship and we have a child together. In addition, it is a decision ready application. Health examination and police check are valid.

Kind regards,

Congratulations on your PR

Are we supposed to keep updating evidence while we are waiting?

You don't have to but some people choose to.

Thanks. I guess sometimes case officers may end up asking for more evidence after 801 has been submitted anyway, so it would be wise to keep collecting evidence.
