Quick questions:
1. I have a dependent which is already on 445 visa linked to my 820. Do I need to add him on the 801 as "Migrating members on the family unit" even if he's already in Australia?
2. I just got my new passport in which I have changed my surname to my husband's one, should I still update my 820 or just use my new passport details with the 801 visa processing?

Hope someone can help me!

Thanks!!
"Once this visa (445) is granted, the child needs to apply for a permanent Partner visa. One way to apply is to use:

Form 1002 - Application by a subclass 445 dependent child for a permanent Partner visa (178KB PDF).

The child needs to apply for a permanent Partner visa before we make a decision about the parent's application."

Step 4.

801 eligibility has nothing to do with when the 820 is granted. It's two years from the time you made the 820/801 application.

Hi Skybluebrewer, so does that mean I have to submit my 801 application form first, then attach the form 1002 as part of the application? I am applying online. Or should I create a separate online immi account for my son and apply the form 1002 first?

Yep, what I meant was, my 820 has been granted last 30 March 2016. It has been 2 yrs from 30 March 2018. That's why I said I'm overdue for my 801 lodgement. Sorry for the confusion.

Thanks Con59. Did you apply online? The form 1002 is separate from the 801 application form isn't it? It will be sort of like an additional document attached to your 801 application correct? like the form 888 for example.

And my 820 was granted on March 30, 2016.But you had to apply for your 801 after 2 years you applied for the 820/801 visa, not 2 years after granting your 820 visa. But now it's better to introduce the child into your 801 application.
I have an agent and everything she does.I know that after my son took the 445 visa the agent completed a form, and then sent this information from a attachment. And on December 20, 2016 when it was 2 years since we applied for 820/801,we brought new evidence for the 801 visa and we have been expecting since then.
I hope to help you with this information, but hurry anyway, time is late for you ...

Everything you submit and write about in regards to the 801 is supposed to detail you and your wife's relationship SINCE the 820 grant. So, you can't write the same thing you wrote for the 820. Just write about how you and your wife have continued to be committed to each other and how you've continued to combine your social, financial and domestic affairs since the 820 grant.

You might want to remove or edit this attachment as it contains many personal details which other members can inappropriately use.

You don't lodge an application for your 801 if you already have an 820 visa. When you lodged the 820 application, it was actually an application for an 820/801 visa (so 2 in 1). Now you simply upload more recent evidence that your relationship is still ongoing so they can assess you for the 801 PR visa. So more recent bank statements, more recent relationship statements, etc.
