Hey there,

I have just been granted the 820 last week (applied Aug 2017) and was expecting to be granted 801 straightaway as we have been in a relationship since 2012 and have a depended child together. Has the department changed the rules for this?

No, the two year period can still be waived. Did you provide de facto evidence for at least the time required for long term relationship criteria? If you did, then try contacting them and ask to be considered. Some people were fortunate enough to get a grant by doing that.

I was just on the phone with the department for nearly 45 minutes. They also say I should be eligible and told me to email the processing centre.
Let's see what they say/do. I uploaded evidence every few month, especially after our baby was born. Unfortunately, not much has happened since she was born as one can imagine. We travelled a few times, but we haven't got any new bills or purchases. Just photos really. It's also hard to produce evidence with me not being able to work or getting any parenting support (even after 820 I get nothing). My poor partner just works all the time to keep us afloat.

The child would have had to be born prior to the application being made to meet the two year LTR criteria. So you would have needed to provide at least 3 years of de facto evidence prior to the date of application to show you were eligible.

Why can't your partner apply for child benefits?

Ah ok. Well, we have evidence provided going back to 2012. At least I'm hoping that is going to be evidence enough for them.
My partner is getting parenting support, tax benefit a&b and he received dad and partner pay, and he works as a casual pretty much full time. But I would be eligible for parental leave pay on the 801 (I think) which would make things a lot easier.

Hi guys I'm little confused with visa process time how long does it take? I got my 820 visa grant on 14oct 2016. And I haven't heard anything yet from the Immrigation yet is this wait normal ? TIA

Grant date of 820 is irrelevant. When did you apply for the 820/801? 2 years after that date is when you became eligible for the 801. If you haven't already done so, you should get onto immi and do stage 2.

Quite the wait... It's not abnormal, and for a while people on here were getting them at around 18 months. Current wait times show the majority are processed in under 20 months so keep being patient. It'll come one day!

I had already applied for my 801 when we got married. my passport was expiring and had to be renewed. It was easier to apply for the passport in my married name and update the visa application. It has made no difference to the waiting time. All of my details now are in my married name except my super which is taking a while to be updated. I have been waiting 18 months now. and have had my new passport since feb this year.

I did attach the name change certificate as well just in case.
