So, I got an email back from the processing centre. They say the 820 decision is final and can't be revised and in that decision we were not eligible for 801. It didn't say why exactly. Not sure if it was because of a lack of evidence or because it was rushed as I requested priority processing.

Hi everyone!
So I haven’t logged onto Australiaforum for a long time but I thought it’s a good time to update everyone and maybe our story can help someone here. We’ve had a really interesting journey especially the last few months. We were granted the Permanent 801 VIsa today (6 September 2018) and it is the best news we could have received in the longest time

So here is our story (WARNING: a bit long!)

My partner is from Yemen (high risk country) and he applied for a PMV 20 Jan 2013 in Cairo. We never used an agent. He had a face to face interview once during the wait for the PMV. Finally, we were granted the PMV 17 Jul 2014.

We applied for the Temporary Subclass 820 on 7 April 2015. The 820 was granted on 17 April 2015.

We received an email from Immigration on Feb 27, 2017 requesting further information for the permanent partner visa (801) application.
We submitted our application for the 801 on 7 April 2017.

We had a few issues in our marriage (as every couple does)…..anyway I decided to move out Dec 17 and back to my parents for a bit. I had sent a Change of Circumstances form to immigration stating this. A few weeks later we reconciled, I moved back but we were in a bit of a rut because of the first Change of Circumstances form I sent. So we followed up with Mark on what to do – he advised that I send another Change of Circumstances form clarifying I’ve moved back and rescinding the first form and provide lots of evidence that I’ve moved back. So we did. And we hadn’t looked back since.

We had been waiting so long for visas by end of July 2018 we had had enough – so my partner sent an email to the Immigration feedback form (as we had heard about) and they called me a few days later asking me where he was (he had gone to try see his family in Yemen). I said he is returning in a few days. Little did I know that they were waiting for him to return so they could do a phone interview for us both at the same time. This occurred on the 7 August - at 7 am! They asked questions such as how does he get to work, how many bank accounts does he have, where did he travel, why, which airline, what time, what did we do over the weekend, about his family, where he works, what’s his position, how much he earns, what our house looked like. They asked him the exact same questions but about me. I thought it was the last step and we’d receive a grant

However, my partner received another phone call yesterday morning asking him questions about my PayPal transactions dating back to 2016! They said they had credible government sources to show that I had sent money to a dating site in 2016!

He was, rightly so, confused by her questions so she sent an email and advised we had to provide a response within 7 days so they could make a decision. I had to digup my old PayPal history to find out what she was referring to. And it was in fact an event my partner and I attended together (luckily the PayPal transaction had our names, had the name of the event, the date, the total cost, the location). I even dug up the old Facebook event from 2016 to show it was a real event and also the old event poster.

It was surreal to say the least.

Well we sent all the evidence to our case officer last night and this morning received the grant! Just an amazing feeling!

No more waiting for visas and collecting and providing evidence!

I hope this story helps somewhat and guides you on your journey. Have faith and I wish you all the very best! Thank you to this Forum and to everyone that has helped along the way.

Mine took nearly 30 months but its weird how they found out about paypal transactions i think when something happens in relationships like a split for couple weeks and immigration knows about it it raises concerns to them about the genuineness and the continuous of the relationship so they start looking for any reason no to grant a visa thats in my opinion

Granted

Just like to add that my visa was granted yesterday. It was a fairly smooth procedure.

I was eligible to apply last year 29 June 2017, but we both were pretty laid back and comfy in our lives being together on 820 that we didn't apply until the 3 years since 820, 29 June 2018. I slowly submitted documents over the course of 2 months or so. Got an email requesting AFP on Aug 24. Submitted AFP and other stat decs on Sept 4, and granted on the next day.

Did you send them any bank statement including that transaction? If not, then it is pretty creepy and that may be breaking the privacy law.

Yes, wait times listed are from 801 eligibility. Doesn't mean a 20 month wait though.

Hello,

I'm not sure if this has been asked before but I appreciate if anyone can shed some lights on this issue.

I have just been granted my 820 in July 2018. Currently I'm trying to attach my completed Form 1022 (changes in circumstances) via Immiaccount. The changes are my employment details and my other personal contacts in Australia previously noted in my Form 80. There is no button to click on to attach new documents and the update information links provided don't relate to what I'm going to submit.

My question is do I actually need to update these changes? If there's a need to, how do I do it?

Thanks in advance!
