I live in NSW and thought that I would need to apply for a 'change of name' certificate. However, after going to the Service NSW centre today, they said that I did not need to complete one as we were married in Australia and therefore my marriage certificate counts as evidence for my name change.

Just wondering how this works with immigration - Will my visa be granted in my maiden name or married name, if my passport says my married name?

Hope this doesn't sound like a silly question, just want to make sure that the process is as smooth as can be to void any errors/confusion.

Thanks!
It'll be done to whatever your passport says. My passport is still in my maiden name but I use my married name. I'm not bothering with it until it's up for renewal.

Using my maiden name on passport and married name hasn't caused any issues. Just means I have to show my marriage certificate if using my passport as an identity document for anything.

I am in the same situation. My husband and I married here in Australia and we just put in the information for our 801 (2nd stage). I've changed my name on everything except my passport and MyImmi account. I'm waiting to do my passport until my 801 is done, as I don't want to throw a cog in the works. However, since your passport will be expiring anyway (mine is still good for 8 more years), when you change your name on the passport, your visa should be completed under your passport name, as it's attached to your passport. Hope that helps.

We subsequently lodged the 801 on 13 July 2017 and it has been 17 months since date of eligibility for the 801. Realistically can we expect it to arrive any time now, given the timeframe provided by DIBP? We have not been asked to provide any additional documents.

Understand that it has been discussed a few times on this forum, but can I confirm if DIBP has a practice of discriminating on the basis of country of origin in place when processing partner visa applications, which can affect their processing time? For this purpose, my wife is Vietnamese and I hold dual Australian-Vietnamese citizenships.

What other factors in respect of the applicant/sponsor can also affect visa processing time? Further note that my wife is employed full-time by an established, well-known boutique accounting practice and completed both her undergraduate and postgraduate qualifications in Australia. As for myself, I am working for one of the Big 4 consulting firms.

Therefore, on top of our genuine relationship and apart from our country of origin, overall I can say our profiles are pretty 'low-risk', but not sure how the Department will view our application from their perspective.

Any feedback/comments will be much appreciated.

Hi, I'm new to this forum. I just want to know how did you calculate the eligibility date for 801? As you mentioned, it's been 17 months since the date of eligibility for 801. Since you lodged the 801 on 13 July 2017, we should wait another 18 month to 24 months as stated on immi website then after that add another 6-8 months processing time?

Lodge 820/801 application
801 eligibility is 2 years after that application date
801 wait times are based on eligibility date.

Hi guys,

I will be applying for my 801 very soon. My brother visited us from Canada in December last year and stayed with us for about 1 month and a half. He would like to provide a statement of support where he gets to say that he visited and he lived with us (since I don't have any family here besides my partner, and our 888 forms are from what were initially his friends and are now my friends as well).

My questions is, what form should my brother use to provide this statement? Since he is not an Australian citizen, I believe he cannot use the 888 form that is normally used? Should we check to see if there is any sort of statutory declaration forms in Canada that he can use and get certified? Would that be acceptable?

Because he's not PR or citizen of Oz, whatever he does won't be considered a stat dec anyway. He can just write or type it up on paper then get the signature witnesses by whatever legal authority it is in Canada. The signature witnessed part is just to prove it's his statement and you didn't write one up and put someone's name down.
