If you don't hear anything after filing the complaint, I'd suggest contacting the ombudsman.

Hi guys I will just tell a little about my case.
Applied 820: August 2016
Request more docs: April 2017
Granted 820: June 2017
Applied 801: July 2018

I have submitted every evidence, 5 888s forms, about 60 files, pretty much it’s all done and ready to be reviewed.

Since I have applied I have travelled 3 times overseas to visit my family around 1 month or less.

I have always travelled alone as my partners ex is always making drama about the 2 kids. However we have made short travels within Australia, to visit his friends and family.

I’m full timer and I have always worked since I’ve been in Australia since 5 years ago. We have been together for 4 years and de facto for 2 years and half. Now my contract will end on December and my sister who lives in America invited me to stay with her for 3 months as she is feeling sort of depressed for personal situations. My question: is it too risky be overseas for 3 months without my partner? Every time I have visited my family we communicate in a daily basis and I have submitted all this as a evidence when we have been apart .

Thank you in advance for your replies

What is everyone doing with regard to police clearances (Australian)?

We uploaded one with my wife's 801 second stage in June 2017.

Are people uploading new ones every 12 months? Are they only valid for 12 Months?

Yes they are valid for 12 months. I think the case officer will ask you for a new one when they open your file but for me personally I will upload the new one just for the completion of the application.

I don't think the 12 months thing matters as much at Stage 2. I can't recall reading about anyone who was requested to redo them. It's not like Stage 1 where the validity of police checks may have an impact on first entry date for offshore applicants and it needs to be valid. I have also not seen it anywhere in Stage 2 checklists to wait until requested to do them like they say in Stage 1.

I personally would be sure to upload proof of communication while you're apart. Also bear in mind the risk associated with remaining offshore while waiting on the 801. It can be decided while you're anywhere in the world, but if they refuse it while you're offshore, you cannot appeal and you also lose the temporary visa (as it only exists until a decision is made on Stage 2). You'd have to find another visa to enter Australia on if you want to return.
