Hello, I'm new to the site, and I need help, everyone will be grateful for the answers. I received visa 820 on September 5, 2016, the answer from the department was not there, after calling the department, the operator said that I could fill in the visa application form 801, since we have been waiting for an answer for more than 28 months. When filling out the form on page 4, it appeared in a red box under my name, this is the (appropriate prerequisite visa) entry
*What to do now, you need to wait for a decision on a visa only then fill out the form?

Lots of people misunderstood the 2 year waiting period. The period is not from 820 grant. It is from the time of application. I applied in Feb 2015, so I was eligible on Feb 2017. I know I am waiting for long time but my situation is not the worse. The worse is when one waits for 24+ months and receives a rejection.

Last year I read in news that immigration reduced number of employees to reduce expense. The intake ceiling is about 125,000 per year, but they processed only 47,000 per year for the last two years. Do the math. LOL

Observing the history of processing time shows increase at the times before universities and schools start i.e May, Jun, Dec, Jan. That is logical as immigration is under pressure to issue student visas. When in December the number of employees drop due to holidays.
In contrast, the processing time decreases on March and August once the classes start and holidays over.

Another element is "Budget fix" and the theory of "Regulation instead of Legislation". Do you remember when Mr. Dutton could not increase the waiting period of 1 to 4 in the parliament? It means he could not turn it to legislation. Since then I saw increase in processing time:
820: 18-24 months (it was 12-15)
801: 18-24 months (it was 12-15)
Citizenship: 12+24 months (it was 12+8)
Over all the current increase was expected due to diversion of resources to tourist visas (new year) and student visas (as they must be here by mid Feb to attend their classes). We may see decrease in processing time on March and after. But due to reduction in intake, I doubt the decrease ever go back to 12-18 months ever again but may return to 18-24.

I see frustration on everyone due to the increase in processing time. But one thing no one does: sending a message to the government.
We are not citizen but our partners are. Our partners can send the frustration message to the government by raising the issue to the government representative (Like what my partner did); she is only one voice though. If you are frustrated, please discuss it with your partner. Your partner is also affected because of the delay.

Thanks so much. Looks like i applied for the damn 801 after receiving the 820 instead of 2 years after application. Ugh. So yeah i only applied for the 801 in May 2017 so it is right that im still waiting 20 months later

You can be anywhere in the world to do Stage 2 or receive a decision. Keep in mind that if it is refused while you're offshore, you will have no visa to return to Australia as the 820 ceases once a decision is made. Best to explain your circumstances for being offshore well in your Stage 2 documents.

Best wishes to your mother on her recovery.

I'm not exactly sure what you're asking. If you do not currently hold the 801, but you hold the 820, and it has been more than two years since you made the combined 820/801 application (which it sounds like you have), then you should have no issues doing the Stage 2 form.

Are you certain you're doing the correct one? Log into immi, click "Create new application", select "Family", then select the Stage 2 assessment form. It will ask you at some point if you hold the 820, and you'll have to enter the details of that application (I think the TRN or grant number but I don't recall which).

You can verify you're on the 820 by doing a VEVO check.

Wait times are from eligibility, not when the documents were submitted. This part is important because when you contact immigration, you need to be correct in how long you've actually been waiting.

I'm assuming based on your timeline, but that may be for a 300... it says you applied Aug 2013. So Aug 2015 eligibility to Jan 2019 (now) is 41 months.

You need to contact immigration first and wait for a response before you contact the ombudsman, because they'll tell you they won't do anything until you contact immigration first (they'll do something if immigration doesn't respond). Again, be very clear that you've been waiting 41 months since eligibility and that you were eligible to be assessed for the 801 on Aug XX 2015. You should also include your TRN for Stage 2 so they can easily pull up your file.

Well said. I have almost the same timeline as yours. Have tried reaching out through the enquiry form but get an automated response each time. Hard to believe that I applied for this originally in Mar 15 which is almost 4 years ago. Hopefully, we have an answer soon.

Hi everyone,

I am wondering if I should do another police check and attach it. I am certain mine expired in Oct 18. As I haven't heard a bleep from the department I am not sure what I should do.

Any tips would be helpful
