801 - phone interview and processing

Hi guys,

Iím just looking for some advice about my 801 visa (I am the applicant).

We were eligible in July 2018 and submitted all our evidence right away and felt like we had a pretty good application.

Iím a PhD student and I travel overseas fairly regularly for my research and my partner tends to take the opportunity to travel when I go (either with me or to do her own thing).

At the start of June (2019) I notified immi to tell them we would both be separately overseas for a few months and I would not be back until August 20th. I asked them if there was anything I should do or provide before then and told them I might have limited email access at times. I didnít get a reply.

Last week my partner got a phonecall from them that she missed and then I received an s56 email through the night requesting evidence for all aspects of our relationship within 28 days (this will be before I return to Australia). This includes statements from my partner and I again and all the other general things.

My partner managed to call the case officer back today and ended up on the phone for 25 minutes in a fairly interrogative phonecall during which she was questioned 3-4 times whether the relationship is genuine and reminded that it is a legal offence to lie. The officer then grilled her about me being overseas but seemed to relent when my partner told her we have a full message/skype history. She also had a momentary mind blank when she was asked what we did for Christmas, so I hope thatís alright!

I have a couple of questions which I hope you can help me with. Firstly, weíre pretty worried about the way this happened. Do they usually contact the sponsor and not the applicant? Are the phonecalls usually like this? What have other peopleís experiences been like?

Secondly, itís going to be quite hard with me being overseas, but we do think we can pull together everything we need Ė we have lease evidence, me paying rent, tax returns, joint car ownership and insurance and stat decs from friends and family and our housemate. Unfortunately, we have been fairly lax with compiling evidence as we go since handing in the 801 application as I was under the impression that I wouldnít have to really submit anything again.

My next question is really about what my options are in the worst-case scenario and they reject us. Weíd need to weigh up the pros and cons of appealing, and at this stage we are pretty exhausted and limited financially.
I have one year left of my PhD and I have a full scholarship (funded by the Australian government). Itís a huge priority to me to finish! Does anyone know if Iíd be able to switch to a student visa if I have a rejected partner visa? My partner has residency to my home country, so while it is our dream to stay together in Australia, we were thinking that one option would be for me to switch to a student visa, me finish my studies and then for us to move to my home country.

Got my 801 yesterday

820 applied - Aug 2016
820 granted - Dec 2017
801 applied - Aug 2018
801 granted - Aug 2019

I am from Ukraine which is I assume is high risk country.

I am 24 and my partner is 25. We were married at the time of 820 lodgement.

We did not make inquires to the department or got contacted by department prior to grant. I just received email yesterday with 2 page attachment saying Granted.

Documents we submitted were pretty standard. In addition to basic requirements (888,etc) we submitted:

- travel together (even tho it did not have both of our names on it but matched Facebook history)
- lease agreement
- Facebook history
- money transfered between our accounts for rent, food, etc . We don't have joint bank account
- proof that we lived with my husband's parents for a half a year
- tax declaration for couple years

I also originally uploaded all docs for 801 under 'other' and not under each section because of website glitch. Then when I logged in the next day I realised there were subsection to upload docs so I uploaded same docs but under correct subsection.

At that stage I was so over the whole process that I didn't bother to write explanation to the department. I didn't submit any additional documents after that.

Also, 2 weeks before I was granted 820 department sent request for form 80. I have suspicion that they wanted to see my working history. I am Analyst and have worked for a number of major Australian retailers. So I think it worked to my advantage.

All in all it hasn't been the best experience but also not the worst. I didn't mind the wait and wasn't too stressed because our relationship is genuine so I was pretty confident everything will work out.

Can someone send a link to excel file? I want to add my details.

We did the 300 to 801 also.
Applied 3 months before you for the 300, and it took a similar time as yours for the entire process.

It's been interesting to look at some PMV to 801 grants in 2019, from the Philippines

JandE from Philippines took 44 months from PMV Application.
jhaddie from Philippines took 45.7 months from PMV Application.
ady90 from Philippines took 46 months from PMV Application.

Hello everyone,
Can you help me with my enquiry I have been so nervous about this.
Currently Im holding visa 445 (dependent child visa) and my dad is the main applicant.
My name has been attached to the permanent visa application with my dad 3 years ago when he was on 820 visa. We applied for visa 801 in March 2017 and now it has been around 28 months.
In Feb 2019 they request us to provide police check and recently last week on Tuesday they asked my mom to submit the Stat Dec again and she did submit on Friday.
The thing Im worried about is I will travel overseas next week (back to my country to take the Ielts test) for 2 weeks. I dont know if thats gonna affect anything.
I am 25 years old and still waiting for that PR visa so that I can go back to uni again, you know the tuition is huge if you are not permanent resident...
Is anyone there got similar experience with my case?
Thank you so much!

Hey guys,
I was wondering if anyone changed the passport and name due to marriage while waiting on 802?
As my passport expired, I applied in my home country for a new passport and wanted in my new name after marriage.
On immi account there was just an option to update them about passport change details. I filled that part and attached my new passport and a proof of registration of my aussie marriage abroad where it states what my new surname will be. So complicated.. but let them figure it out. I updated them😊

We did that while waiting for the 801.
Pretty straightforward really.
