Hi, I'm in the same boat.

German applicant: 35 years and waiting for 820 for 23 months by now (previously on PMV).
Only contact has been that "Application is in progress in Dec 2019 and June 2019)

Check with others, I am sure you can lodge 801 one month early around 28 Nov 2019. Best of luck !

I think you can only lodge the second stage, the 801, after the 820 has been granted.

It is normally automatic to go to the 801 from 820 within a few minutes, if you are eligible.

However, some haven't, but do get fixed after an enquiry, but again, only if eligible.

That is correct, you are given a month early, to lodge things before they 'might' look at the application on the eligibility date.

The processing times of 20-27 months means that 75% were processed in 20 months or less, and 10% took over 27 months.

The recent 820 grant times for UK applicants, on this forum, has been between 5 and 16 months.

The average 801 grant for UK applicants recently has been around 11-12 months, from 801 eligibility. (Your eligibility being 29/12/2019)

Processing time for subclass 801 visa is from date of eligibility, ie: 2 years after the 820 application is lodged.


However, some applicants. who are eligible to go direct to the 801, have taken 16 to 20 months to get the 820, BUT, followed by the 801 a few minutes later.

If your 820 wait goes beyond 24 months, you may well get the 801 at the same time as the 820, ending up being faster to the 801 than most other people, on normal processing times.
Thank you for the advice much appreciated. I hope you’re correct and they process my 820 and 801 together.

Throughout my waiting time, every 4-6 months I’ve routinely uploaded photos, utility bills, bank statements etc.

I’m preparing one final upload for a couple of weeks time (6 or so weeks before eligibility for 801)

I’m going to upload:
-Renewed 888 statements
-Renewed personal statements
-summary of all bills and bank statements
-flights/trips we’ve taken during our wait time
And put a cover sheet sayings its all for 801.

There are so many photographs uploaded to my application as a timeline for my relationship.

Do you think I’m required to continue upload this kinda stuff after the eligibility date? Like surely they will have everything they need at this point. Full 2 years of bills, photos, statements, health checks, police checks etc etc. and then a final upload summarising all of it for 801 a couple of weeks before eligibility date.

We got 801 finally granted this afternoon.
820 lodged: 8 May 2016
820 request for more info : Nov 2017
820 grant : 5 Dec 2017
801 lodged : 28 April 2018
801 request for more info : Oct 2019
801 grant : 8 Nov 2019
Total process : 3 years and 6 months approximately.

Aissie Asean Education

Partner Visa (Permanent) This visa allows Australian citizen, Australian permanent resident or eligible New Zealand citizen's factual partner or spouse to reside permanently in Australia. It is usually only available to people who currently hold a temporary partner visa (Class 820).
If the holder legally enters Australia, the permanent visa cannot be cancelled under section 116. If the visa holder has not yet entered Australia, the visa can be cancelled in accordance with section 116 without further notice.

If the 820 hasn't been granted, that bit might confuse someone, and confusion might cause delays.

Best just to update normally for the 820, and hope you get an 801 immediately afterwards, if eligible.
