Congratulations The Peninsula! 🙂

Did you submitted the AFP check for the 820? For the 801, did you submitted the AFP for both the applicant and sponsor?

We were never asked for the AFP check for the 820 despite the initial one provided for the PMV had long expired so was thinking just submitting the AFP for the applicant when it’s time to submit the 801 application.

Any advice would be much appreciated.

I submitted a police check for 820 upon being asked for one. My partner didn't have to for the 820 but she submitted one for my 300. On the website it doesn't ask for a one for Stage 2 as you would have submitted one for your Stage 1 (820) application but both my agent and a few members here stated that a case officer may or may not ask for an updated one, guess it s based on what sort of mood the officer is in that day. Haha. I decided to submit it anyway and was shocked when I got a call that my 801 came through, wasn't expecting it so soon.

We provided 2 form 888, Stat dec ( applicant & sponsor), further evidence of relationship since the grant of 820, Photos joint bills and joint travels, AFP both sponsor and applicant ( we use the same for 820).
we got the grant 2 months and 3 days since documents submitted.

After 4 enquiries we were granted the 801 on the 27 august 2020 38 months waiting

Many thanks The Peninsula for the clarification

I'm surprised to hear the Department called to inform you of 801 approval as usually they don't contact unless further information is required.

You must be so relief the waiting game is over Wishing you both lots of happiness!

Congratulations AJoyce!

Is the Stat Dec for both the applicant and sponsor in the 801 stage necessary? I thought the question section in the application regarding the couple's financial/ social aspects and mutual commitments etc covered details of the relationship.

We didn't do the Stat Dec for our 820 application, but after reading your post don't know whether we should for the 801 process.

Any advice would be much appreciated.

We still have a longgggggg wait ahead as our 820 was only recently granted. Hopefully when the time comes it'll be a speedy and favourable outcome like yours

Direct 801 Grant Criteria

Hello everyone,

Me and my wife (an Australian Citizen) started living together in Canada since August 2017 and got married October 2018 and moved to Australia on January 2020 and I applied for Partner Visa 801/820 as soon as we arrived in Australia.

Based on my understanding in order to be qualified for a direct 801 (Permanent Status) grant as oppose to 820 (Temporary Status) firstly then 801 you should have lived together in a De-facto relationship for more than 3 years.

My question is since we have been living together for more than 3 years and our documents uploaded indicate that as well, what can we expect to have granted? would it be 801 directly OR 820 first and shortly after 801 OR worst case scenario that we still have to wait for 2 years from application submission date which is against the 3 year De-facto rule.

I appreciate if I can get a feedback from anyone with information on the 3 year De-facto rule or on a similar past case.
