Based on my understanding in order to be qualified for a direct 801 (Permanent Status) grant as oppose to 820 (Temporary Status) firstly then 801 you should have lived together in a De-facto relationship for more than 3 years.

My question is since we have been living together for more than 3 years and our documents uploaded indicate that as well, what can we expect to have granted? would it be 801 directly OR 820 first and shortly after 801 OR worst case scenario that we still have to wait for 2 years from application submission date which is against the 3 year De-facto rule.

I appreciate if I can get a feedback from anyone with information on the 3 year De-facto rule or on a similar past case.

With Many Thanks,
The best option would be to apply and provide info including proof of your 3 year relationship and then send a query for a direct PR consideration. Some get picked up, others don't. There is no guarantee but no harm in trying.

Hi guys,
I have received an email about RFI. My questions are do I have to provide new witnesses form 888?
I have uploaded my spouse passport and they still request in the letter. Do I have to submit a new one or just leave it since I already scan of his recent passport signed by JP? Any advice would be great. Ta

Thanks alot for your great suggestion, I will do as you suggested.
However I can not find the 3 year De-facto Direct PR rule anywhere in the Immigration website in order to refer to it in my query sent to them. (I initially red about it in a forum)
Would you be able to guide me where I can find it or how I can reference it.

Thanks,
Hesam

Hey guys great to hear of everyones success stories. Just unsure if there is a deadline for submitting your 801 application, we summited our 820 on the 19th of September 2018 does this mean we must lodge our 801 application on the 19th or is OK to summit it a few days later? For example the 23rd, thanks

Did you receive another email saying you can progress your 801 application ? You can submitted one month earlier from the date your first lodged 820.

It has now been some time since I wrote my post and never had an answer

My question is per the time from one visa to another

On the internet it says you apply for the temp 1st which takes up to 2 years Waiting time

During thistle period you may get your temp Visa quicker

The you must wait another 2 years to get Permanent Residence if all is okay with your application and things have not changed

But here is where it gets confusing
When does the 2 years start from from 802 to 801

1) the days you get your Temp Visa
2) or 2 years after you submit your application in the first place

Or have they changed the goal posts and introduced a new time table?

I am not sure if mine will answering your questions. But when I applied mine 820/801 are combine.
I received my 820 approx 19 months.
I lodged my 801 within 23 months since I have submitted my 820/801 application.
RFI for 801 within 1 month after I lodged my 2nd stage (801).

You should make an enquiry to [email protected] and quote you TRN & your client ID asking for ETA. They will pick up asap.
