Hi guys quick question when I applied for my 820 visa I applied through mail with all the paperwork I included the form 80 as it was recommended for me to include everything! Looking at my online application last night for my 801 visa I haven't included another updated upload of the form 80 do I need to do this again?? I chose to do the 2nd stage online as I thought it would process quicker should I now add in the form 80 again or wait until a case officer contacts me I am now 12 months since eligiblity . Any advice would be greatly appreciated

Thanks Alikiwi :-)

It's a bit confusing

One site says change of circumstances are things like name, address, babies or marriage..
Another says engaged
And on the form it says you do not need to let us know of a change of circumstance if you're visa has been granted..

I'm so confused..

And I'd cal them and ask but I'm concerned that I haven't let them know .. even though I'm still not sure it's necessary ..

Has anyone else been in the same situation...

Thanks

Doing it online wouldn't make any difference to processing time, just easier to do. I have no idea, about form 80, but seems redundant to do it again, but????

I just really wanted to know if we should or shouldn't register our relationship. All the govt website says is that we need fryer proof that we are a couple still, it doesn't say how or what we needn't to do that.
Any advice would be great!

It sounds like you'll be applying for the 820? I'd suggest starting your own thread - you have a lot of questions here and more people might see it if it's in your own thread or at least one that reflects the visa you'll actually be applying for, like one of the 820 threads.
If your partner holds the 309 visa, he won't be applying for the 801 - he'll be submitting evidence for the 100 visa instead. But the answer is the same either way - there's no need to register your relationship just for the sake of providing evidence for PR. They're already satisfied you're in a de facto relationship or they wouldn't have granted you the 309. What you're doing now is providing evidence it's continuing. Is registration great evidence of that? Sure. It certainly won't HURT to register it, and in NSW it's relatively easy to do, I believe. But it's not something I would worry about as long as you have adequate evidence your relationship has continued, you're continuing to live together, etc. HOWEVER - do you have adequate evidence? See below for more comments.

Quote:
We are in a same-sex relationship so although we are married in France, our marriage isn't recognised here and we are considered de facto. I know at in nsw we can register our relationship but it costs $250 so I am wondering if anyone knows, does it matter if we have done that or not? Are we more garaunteed to have the visa or have it quicker?
No, you're not more guaranteed to get the visa, and definitely not to get it any quicker. It makes no difference to processing time. It is good evidence, though, especially if you're lacking in other areas.

And does the registered relationship certificate replace having to prove your relationship is ongoing or do you just include it as part of the proof?
No, it absolutely does not replace having to provide evidence your relationship is ongoing. It is just one piece of evidence - GOOD evidence, solid evidence, STRONG evidence, but it's not enough by itself, just like just being married is not enough on its own.

The other problem is that we are living for free with my parents and have done since we arrived in Sydney six months ago (we travelled for a few months on the way over). We therefore have no joint bills. The phone is in my name only, and we have no rent, electricity etc. We have grocery payment proof on our seperate bank account statements but not from our joint account. We have a joint account but as we're saving money we have no big purchase from it.
How do we go about proving our relationship and that we're living together etc without all those things?
This is where it will be tricky for you, but I bet if you think about it you can manage. If you were both living there - surely you both have mail coming to the same address? Surely you both have some type of bills coming to the same address? Personal letters/cards/invitations? Anything at all? Collect mail from each month addressed to each of you and you can prove that you were both living at the same address that way. Show your bank statements and any receipts that demonstrate you were each shopping at the same grocery store local to your parents, for example. Did you take turns paying when you went out? Think about how you each pay for things for each other and/or the household, tell Immi in your statement about how you each do that, and provide whatever evidence you can find of that. Have your parents write you a statutory declaration saying you were living there and what the financial arrangements are/were. Did any friends visit you there? Consider having them writing a stat dec, too. Hopefully this gives you some ideas!

In your case, registering your relationship and getting that extra-strong piece of evidence might be a good idea considering the difficulty you're going to have with evidence in other categories - but it's not going to erase your need to still have evidence in categories like shared finances, either. So I would do what you can to gather as extensive evidence there as you can, and if I were you, I'd probably register my relationship, too, just to cover as many bases as possible.

And honestly, with atypical situations like yours, a consult with a registered migration agent isn't expensive and can give you a little peace of mind. If you can do it, I would.

These are the Documents/evidences my case officer asked for :- please give me feedback / Suggestions

1. Property ownership documents, e.g. mortgage documents, Contract of Sale/Purchase, Certificate of Title.----

2. Statements from applicant‘s family as evidence they are aware of the couple’s relationship and accept the relationship.------

3. Statements from the sponsor’s family as they are aware of the couple’s relationship and accept the relationship.

4. Please provide evidence to demonstrate how the applicant and the sponsor communicate with each other’s families.

5.Recent utility accounts (rates notices, gas, electricity, telephone including mobile, internet connections).

6.Letters (including envelopes with legible postmarks) received at your current home address in joint and separate names.

i have managed soo far
1. Purchase of property

2. From my family ( Mom and dad) one statement , Sister and brother in law-one statement certified by Public Notary - with their colour passport copies and birth certificate

3.From my partner's family ( Mother, two sisters) , 3 statements all together- with their Driving licences from Uk and certified by post office ? IS that ok ??

4.In relation to communication- i have taken snapshot of past and previous call summaries from my phone and from my partners phone along with , messages sent to each other , messenger messages from partner facebook, etc Also i have

Provided our conversation while we are away - even though have not been asked ?

5. Rates notices, Gas joint invoice, electricity joint welcome letter , internet invoice , phone bill invoices, .

6.About Letters;- 12 each separate letters same address and two letters joint with envelopes , also many greeting cards , and current Vet invoices in both of our names ? Is that enough .

Thank you for the reply! Yes that's what I'm thinking I guess at this stage it's best to wait as my case worker will surely contact to say it's incomplete if they need it submitted again

Finally got my second National Police Certificate in the post today after a three week wait. Also uploaded a couple more documents and pictures, as additional evidence.

Now to sit back and wait... hopefully not too much longer.

Hi guys! It's been a while since I read and been in the forum! Thank you Mish for starting a new group, I was sort of ready to cry back reading from the old one (Which I will still probably do! Heh)

My eligibility date to apply for my 801 will be in September. Now when I applied for my 820 it was via paper, and I will be renewing my passport in July. I went to the immigration office here in Perth to ask them on how I can update my passport details but told me they can't help me as they no longer accept inquiries in the office in person. They told me to update it in my iMMiAccount, but I forgot to mention that I lodged via paper so basically I can't update anything online.

On September, will I be allowed to submit my requirements online even though for my 820 it was done via paper? I want to do it online now so that when my new passport comes in, I can easily update my passport details. I will be going outside Australia in November too.

Thank you in advance for your help!

X
