457 Cancelled

We were in AU for 3 years on a 457 visa with my husband's employer (overseas business sponsor). We came back to the USA temporarily 9 months ago, thinking everything would be ok to return because our 457 Visa was good until July 2019. We got an email from Immigration in January, saying they cancelled our visa because they got info that my husband's employment was terminated. NOT TRUE. He's been working at this company since 1992. The only thing that happened was the Overseas Business Sponsor approval expired. Instead of getting notice, our visa was cancelled! Do we have any recourse? We are now set to go back to AU (with the same employer) however now we were told we had to start from scratch again. This is upsetting especially in light of the new rules for the 457. Any advice or experience?

Weren't you aware of the employment conditions attached to a 457 visa?

If you are overseas, a 457 visa can be cancelled without prior notice.

Yes, you will now have to start from scratch.

With the recent changes, I'm getting the impression the whole 457 stream has basically been put on hold, so it it impossible to provide a sensible answer at this stage.

Apparently I thought we had more time to get a new sponsor. I've just re-read all our papers and I see I was mistaken.

You only have 60 days to find a new sponsor, so if you were overseas for 9 months, that's the reason the visa was cancelled without further notice.
