De facto Conundrum! HELP!

Ok here is my situation it is coming up to a year of living with my defacto parther and we will be applying very soon. However I am not sure if we have enough evidence or need to find more. I'd love to wait it out but I have already used my year of work and am here on a 3 month tourist visa at the moment cause me and the misses didn't fair too well apart and figured i'd come back and we could apply for this visa (a lot more work then I thought). Anyways here is the evidence we have:

- 4 months living together (no lease, however real estate agent has signed letter stated we made them aware of me living there during this time, and stat dec from partners father cause he took over the lease)

- At this time there isn't much evidence of me contributing because I was still paying rent at another location. But I did split on grocerys and peterol which can be shown on bank statements.

- 6 months lease in both names with bank statments showing me contributing to all bills

- birthday, valentines cards, birthday invitation, and wedding invitation

- not many photos but bank statement proof of our travels together

- emails sent to each other on our time apart

- Dog together
- Car insurance in both names
- Bank account in both names

- 2 months me living at the new location with her and her father not on lease and her supporting me because I cannot work on a tourist visa. Stat dec from her father stating I am living at this location.

I am at a dead end road really because my visa runs out soon and I need a work visa because my partner plans on going to uni and I need to help support us. I have two uni qualifications which can get me work!
Any help appreciated!!!!!

Give them all of this evidence and also explain your situation in detail when you and your spouse write your letters. Date the pictures that you have together as well.

In your letter also explain that due to you being unable to work that the bills aren't split 50/50 but you contribute as much as you can. We were in the same situation (my spouse - Australian - is here on a tourist visa since his work visa ran out) and explained that we chose to sacrifice income for us to be together and my spouse would be finding work as soon as he was back in Australia.

The info about your relationship in your letter is really important and it is where you are able to clarify for example why you might not have had the lease in both your names for the full 12 months.

So you have lived together for a total of 12 months, even though your names weren't on the lease the whole time? Letters from the realestate agent might help somewhat.

How far back does your bank statements (joint account) go back? and the insurance?

You don't necessarily need a lot of photos, just a sample is fine I think. Perhaps it is a good idea just to see what immigration say about your case before you lodge the application. It's not cheap to lodge your application, so I think you would want to be fairly confident with your evidence.

Insurace and bank account recently since I've arrived again. How can I present my case before I apply? I've called and asked about the proof of us living together but they simply said it depends on the situation if the proof is accepted. I figure since we have signed documents from the real estate agent it would be enough my time is running out to apply before my visa ends. Thanks for both of your help any more advice or people with the same experiences advice will be appreciated!

It's not going to be easy. I would read through all of the requirements one more time, search here on defacto for more info, go through all your old files and documents and see if you can find further proof. You might be able to find a migration agent that gives a free initial assessment. Maybe ask your friends and family if they have more pictures of you and your partner together.

Look up the Immigration Advice & Rights Centre, and give them a call. Its a free service & was very helpful to me and my partner. You can tell them your circumstances & they will give you an idea of whether you'll meet the requirements with the evidence you have.
