Applied for Immigration - subclass (885) in January 2009 - Need suggestions & Help

Hi

My wife and me have applied for Immigration under sub class 885. My wife has been assessed as ICT recent graduate and has secured 7 band. Infact when we were planning to apply last year we completed our police check and medicals for which we supplied our documents when we applied. We checked the status online and it says as follows :

Application General Skilled Migration

08/01/2009 Application received - processing commenced
08/01/2009 Application fee received
25/02/2009 Application being processed further
View your receipt details
Document Checklist

Person 1
08/01/2009 Bridging visa granted
18/03/2009 Health requirements finalised
13/11/2008 Medical result received
13/11/2008 Chest X-Ray report received
13/11/2008 Chest X-Ray film received
13/11/2008 HIV blood test received

Person 2
08/01/2009 Bridging visa granted

When we called them last financial we were told that all the applications are being processed as per priority processing and also that it may be the same case next year , We are currently confused and wary and have no or limited information on what is happening with our application or what we should do next because it is almost 6 months since we applied and we have not been allocated a case office as well.

My wife is working in IT since the last 6 months as a software engineer.
We will appreciate if anyone guide us !!

Welcome to the forum Santosh and I'd suggest the following may help your understanding of the situation.
1. Have a read of Sticky thread #4 info re the immi priority processing and you'll see that it's an order of
a. people with employer sponsorship
b. state nominations
c. CSL listed jobs
Immigration having stated that any applications outside of that are not likely to be considered in 2009/2010 [personally I think the years will be extended]

So first thing for you to do is to see if your wife's qualification category as assessed by ACS is on the CSL - there being a comment that all occupations on MODL are.

That should see your application eventually considered though it'll be in group c. , and things can change if new regulations get introduced and that has affected some people already.

You could then look at what other options are and it would seem to me if you want to give some more certainty to the situation, you could:
. look at a possibility of a 457 visa employer sponsorship but that then ties your wife to that employer which may not be too bad for you if you just look at as an interim measure until the 885 is considered.
OR
. seeing as your wife has employment already, look at getting a state nomination so as you can have the 885 visa considered as an 886.
One poster having received an immi letter to say if you get state nomination, a 175 visa can be considered as a 176 and I assume the same treatment would apply for a 885 to become a 886 - something you may want to consider checking with immi first, ideally by email.

thanks for the quick response and the suggested alternatives.

We were thinking of state sponsorship as an alternative to speed my application processing but not sure where to start. Can we get state sponsorship only based on my wife's Master's degree that she got here or is experience required for it.

I did read some where that currently state sponsorship is not available for Computing professional graduates. Look's like they are closing every possible opportunity for us and others too.

Some help guidance with state sponsorship will really be appreciated.

I admit that I do not have time to keep up with all finer detail and have not heard of state sponsorships closing; state nominations decisions being as far as eligibility goes an issue for state governments, and the eligibility not differing too much state by state, a basic requirement being that an applicant has approved qualifications for an occupation on the Skilled Occupations List [SOL] , something I expect your wife would have to be eligible for an 885.
Some states require an applicant to have a job offer and that's where your wife already working is hopefully an advantage in that her employment is secure enough to get a formal job offer.

But go to Department of Immigration & Citizenship for 885/886 visas, the 886 being for nominations and you'll find there links to the various states and there'll be further links to applying for state nomination, very similar to an immi application but it should come through fairly quickly if they are not closed or restricted.

Under what seems to be current approach, once you have a nomination, the application for an 885 would then be considered as an 886 once you notify immi [another form likely being needed].

With an 886, there is one requirement of staying in the nominating state for two years.
