Hi All,

Well it has been a while since I have been on here and posted anything but I felt that it was the right time to give you all an update on my situation.

As many of you would recall, my fiance and I had our visa refused back in March this year and it was a tragic day for us both and I know a lot of you shared in our pain. At that time I made a decision that I didn't feel my mental health was robust enough to proceed with any of the alternatives (MRT, going to live overseas with him or another visa application) and we parted ways and our relationship became a victim of a cruel and sometimes unjust system.

Since that time I tried to move on with my life...well to re-assemble it really however a couple of months down the track I realised that while I had regained some emotional and mental strength by no longer being in the agonising process anymore, I was miserable...miserable with him in my life and I had a decision to make.

So we got back in touch and our love hadn't diminished one bit and I suddenly felt that I had the strength to go forward, to try another option and to go up against the system and prove our love is real and that they were wrong, so very wrong.

So I sought the advice of an immigration lawyer and he was surprised to see our refusal letter had "nothing" of substance in it. He said it was clear they were worried and chose to refuse on that basis but there was no evidence at all as to what they claimed (that our relationship was not genuine) and if I have taken the matter to the MRT it would have been a good chance to succeed. One of the most sickening things he told me was that sometimes Case Officers refuse people's visa's just to see if they are a serious/genuine couple and if they will re-apply!!! That took my breath away. I could not believe that someone would treat us, or others, that way but this man is well renowned in the field of immigration law and I fully trust and respect his feedback.

I had made a decision that I could not put myself through the 2 years wait for the MRT outcome so I had let that timeframe to apply lapse, however he felt that we had a good chance for a positive outcome if I went and spent some time with my fiance in Ghana and showed more proof that the relationship was ongoing and genuine and possibly marry over there and apply for a partner visa instead of another prospective marriage visa.

So this brings me to today, where I am in possession of a ticket to Ghana, leaving in September and I will be staying for a glorious 3 months! This will be a wonderful time for us. We can finally be together and live as a couple and enjoy the amazing benefits of communicating without any technology to assist us lol.

It will be a time of consolidation but also a time where we will rally our strength as a couple so that we can face the immigration process again. I have to be honest and say that it is with great trepidation that I will re-enter that process as we have been chewed up and spat out once...unfairly, but there is no other way to truly get what we want, and deserve, without getting back on the bike so to speak.

So here I am. Wanting to share with all of you who have supported me and shared our pain that the story may yet have a happy ending. It is a long way off but every journey starts with one step...so here we go!

Thank you Sunnysmile. It is bittersweet being "back" in the game...but the love and support I have found here is comforting as I look forward towards another application...or should I say - BRING IT ON!!!

Thank you for your kind words Sunnysmile. I know our love is real but it still didnt stand up to the system so I'm going to do my very best to make it impossible for them to say no this time.

Welcome back melandabdul! I am glad you made the decision to try again. It did not feel right to give up on a genuine relationship because a particularly mean CO decided to refuse your first application . Good luck ! I am still here waiting, close to 2 years, seeing many people coming on the forum then moving on with their visa granted. There are few of us waiting and seemingly forgotten by the department.

Thank you Krissaid! I am sad to hear that you are still waiting and close to 2 years...how are you surviving through this torture? Please please please try and stay strong. An answer could be just around the corner and what a wonderful moment it will be when you finally get your YES!!!
