Can I apply Visa 457 on shore?

Hi everyone,

I found this website through searching on Google. I'm new here and having quite serious issue. I applied for Visa 485 and got refused because I nominated the wrong skill. Now I can't apply for 485 anymore because I was graduated more than 6 months already. My boss agreed to sponsor me. But I went through several of agencies and some of them said I have to apply off-shore, on the other hand, they said I can apply on-shore. I'm confuse. Right now I'm holding bridging visa A and will be expired on 14 Sep 09.

My question is,

I'm holding Bridging Visa A. I have been refused a visa. Can I apply for 485 on-shore?

Usually, unless there are instructions on the immi site to say otherwise, you can apply for a visa in Australia and there is no such instruction for the 457.

The exception can be whether your existing visa has a no further stay clause applied to it and I'd be surprised if that was the case with a bridging visa for they are usually granted while you are awaiting determination of another visa as in your case.

That situation is mentioned on Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass 457)

You should be able to get a clear confirmation from immi direct on Ph. 131881
