Pls help - Onshore Partner 820/801 Visa

Hey,

Need some advice/tips/info from yous please.

I am from PNG. Been in a defacto relationship with my Australian partner since 2014. Unfortunately no kids yet. We have ample evidences;
- Lease agreement under both our names
- Bills under both our names
- Witness Statements (10x)
- Police clearances for myself (both PNG & AFP and are current)
- Police Clearance for my partner (AFP and current)
- Medicals completed and current (These medicals were done in July 2017 for my onshore tourist visa)
- Joint Bank account statements
- Travel itineraries of my travels from PNG to Australia since 2014

I am currently on a multi-entry tourist visa which expires 12/3/2018.

I recently secured a new job in PNG on a Fly-in Fly out roster with 19 days onsite and 9 days break. My Point of Hire is Cairns and I have my contract to prove this (which am intending to upload as another evidence).

I am intending to lodge my Partner Visa 820/801 sometimes early March 2018 or late Feb 2018.

I have a few nagging queries here if someone can help clarify;

1. Since I have been in a long term defacto relationship, can I qualify for permanent residency (801 visa) immediately after my 820 visa is granted?

2. I am intending to lodge a completed / full application (can't recall the right word) meaning I will include my medicals and Police clearances, will my 820 visa have a chance of being granted in no time?

3. On my work schedule I will be at work in PNG when my Tourist visa expires. I intend to apply for a onshore Partner Visa 820/801 so I have to apply sometimes before my tourist visa expires and then the date has to fall on my break days of 8 days. If I apply onshore and since I only have 8 days of break before work, will I be able to get a BVB asap to travel overseas for work?

4. What if I apply onshore, travel back to work in PNG and my tourist visa expires.....can I still travel back to Australia on a BVA (taking a BVA will kick in after my current tourist visa expires)?

Bit confusing here and need help....

Yes, if you have sufficient evidence to prove defacto going back 3 years or longer.

Unlikely, but miracles happen. I wouldn't be counting on it though.

Don't think they are granted as quickly as that, but no personal experience of it. I think from what I have seen here it takes a few weeks usually to process it.

No. The the BVA only kicks in if you're onshore when your current visa expires. If you're offshore and you have applied for 820 and you have no current visa to get back into Aus, I think that you could apply for another tourist visa to get onshore then apply for BVA to be instated when you get onshore. Not sure how this would work in practice. I wouldn't recommend doing this as it leaves things up in the air a bit too much. I would consult an RMA if you have no other choice but to do this.

It's discretionary. If there is enough evidence, the sc. 801 may be granted straight after the sc. 820.

No, it won't be. It will probably take 12 months or more. Best to do visa medicals and police certificates later, unless specifically requested.

I have been getting them in about 2 days, but best to allow yourself some leeway and apply early on in your break.

No you cannot. A BVB must be in place. Keep in mind that next year there may be a requirement for the sponsorship to be approved first, before you can lodge your visa application. Also, if you are going to continue working in PNG, be aware that the travel facility on a BVB is for a limited period only.
