Genuine temporary entrant question: Student to Partner Visa advice needed.

Hi,

I am an Australian and live in Malaysia. I have a Malaysian girlfriend. We have been together for 4 years and living together for 1 year.

We want to go to live in Australia in the next couple of months.

We don't want to apply for the Partner Visa from Malaysia as it takes too long to process.

Our plan is for my girlfriend to get a student visa and then once in Australia apply for a Partner visa. Has anyone done this before?

Also, how would this situation affect the "Genuine temporary entrant"? i.e. what should we say or not say?

You should not use student visas for your intended purpose. Unless you lie in the application, you will not be able to meet GTE requirements.

A better option may be to apply for a tourist visa to visit family. Once in Australia, you could re-consider your options.

Seriously?! ... Australian visas are for genuine applicants only... don't abuse the system

There are countless people that are trying to get off Student Visas and on to Partner Visas.

Not many think it is a good idea, and end up stuck with expensive education fees. Many think they can just cancel the Student Visa and retain the Bridging Visa A that get issued after a Partner Visa application.

The fact is that Bridging Visa A is part of the Student Visa so if the Student Visa is cancelled so is the Bridging Visa. No that's a very big problem as you currently have no visa!

So we apply for the partnership visa while on the student visa, and when the student visa finishes we get put on the bridging visa right? Does not seem difficult to me.

Obviously you will have to declare the relationship in the student visa application, so that will make your GTE slightly more complicated. But who knows? Maybe it will work.

I advise you to re-think your approach. Student visas arenít that easy to obtain anyway and ( expensive) course fees will need to be paid up front.

No idea.

I advise you to re-think your approach. Student visas arenít that easy to obtain anyway and ( expensive) course fees will need to be paid up front.
The only other approach I see is to apply offshore and wait the X years.
