Visit Visa 600 Refused

Hi,

My Sister-in-Law recently applied for a 3 month 600 Visit Visa (Tourist Stream) from Pakistan to visit us supporting my wife during her pregnancy and post delivery. She is a student and her Father with excellent bank balance was bearing all costs towards her Visit and daily needs. I sent an invitation letter and letter from Hospital and GP. I also submitted my bank statement and salary slips. Her visa was refused stating that she is a Student and does not have an incentive to return back to her Country and they are concerned that she won't stay in Australia temporarily.

I have been given right to appeal in tribunal. The situation is that my Wife has given birth to the baby and needs care at home.

Can you please tell me if my wife can re-apply with a different visa (Family Sponsored) but she is only a House Wife and dependent on me. I work full-time and earn a good salary. We have a joint bank account where she can show 10,000$ in her bank as financially capability to support her Sister's visit. Also, she can attach my salary slips as well.

Can you please guide us the best way and visa type including supporting documents?

It doesn't sound like the issue is your salary/ability to support your sister-in-law, the issue is that she's a student and therefore doesn't have strong ties to her home country that would motivate her to return home after her visa ends. So unless that can be addressed, she's likely to get the same outcome trying again.

As Maggie said, if you are going to reapply you would need stronger evidence of an incentive to return home.

Your sister-in-law could lodge an appeal at the Administrative Appeals Tribunal (AAT). The advantage of this route is that she would have an opportunity to present her case in person. However, the average time to receive a decision on visitor visas is currently 208 days.

Thanks for your feedback Maggie!

I have seen some friend's Sister's received visit visa and they are students, no bank balance, no assets.

What if I get a solid letter from Hospital and write a strong letter myself as there's no help available to my wife locally and she needs help to recover?

Will the 600 Family Sponsorship work in this case? Also, what if she opens a Bank Account and put handsome amount of funds in her account. Also, will Hospital letter and our own letter help? Please note that my wife is a House wife with no local help available to recover and she has a joint account with me with unrestricted access to the funds.
