Form 80 - Part K- Character- Offences of person included in application

Hi there,

Very specific question: In the Form 80, Page 9, "Part K- Character", it is asked "Have you, or any other person included in this application, ever been convicted of an offence in any country (including any conviction which is now removed from official records)?"

I am not sure what to understand there, and thus, what to answer. I have absolutely nothing to say for me, but my dear husband (he is Australian, we've been married two years and applying for onshore Partner Visa), has unfortunately had some offences in the past, like drink driving, "resist" arrest", and the worst one "assault public officer", but they are all very old (it was 20 years ago), he got them all removed from his records and had "only" fines and points taken, but never been "convicted" as in put in jail so i don't know what i should put in that question. I would be most grateful for any help on this.

And is it stupid to think that my husband is not "a person included in this application " in the sense that he is Australian and not applying for any visa, so maybe it just concerns persons that you have on your application, like kids or parents maybe? Really don't know, so sorry if that sound stupid! ;-)

If he's Australian, then he's not included in your application. If you're applying for a partner visa, he needs to get a police check and they'll be aware of his record.

I think 'included in this application ' refers to if there is/are any dependent/s or anyone else you are including apart from yourself for the visa. Not your husband, as what Maggie May said, your husband is subjected to the Australian Police Checks. He has to fill in the Form 40SP too and maybe theres some questions there (No 43) with regards to offences.

From my immigration lawyer/agent, it is just you who is listing your offences so sounds like you just write you've never had an offence, but on another note, your husband's record will be considered in the application. He will need to provide a complete police certificate including 'spent' convictions.
