Should i wait to apply for pmv after visitor visa refusal?

My fiancÚ and i were planning to apply for a fiance visa before the visitor visa but due to coming short of the required funds at the moment we applied for a visitor visa so he can be here for the delivery of our baby girl. But it got rejected due to him being a student and having no strong ties to malaysia as a reason to return. There might have been other reasons but this was the only one given. If we apply for a pmv now will it affect our chances? As i heard the processing time is 13-16 months which gives him enough time to finish his diploma and come here if it gets granted which is what we want. Will applying a month after the refusal affect the chances of our pmv?

It won't affect the outcome of the PMV but unless circumstances have changed since the refusal of the last tourist visa then the outcome would be the same as the last one.

Applying for a PMV & then a tourist visa will not change the decision they still look at the genuine visitor requirements.

Have you looked into if his diploma would be recognised in Australia. IMO there is no point in finishing the diploma in Malaysia if it will not be recognised in Australia.

The course will be recognised in Australia. And if we do get it before he can transfer to an Australian university to finish it

Ohh no we don’t want to apply for another tourist visa because therenis no point.the visa was for him to be here for the delivery of our baby and Our baby will be born before it would even be processed. I just want advice to know if i should wait a while to apply for the pmv or if it’s okay we apply a month after his tourist visa refusal.

He could apply for a PMV tomorrow if he wanted to.

Make sure you supply alot of evidence as from what I have heard the embassy in Malaysia is very tough. When embassies are tough IMO it is better to supply too much evidence than not enough.

If you want search for 'chicken999' and read about her dealings with the embassy in Malaysia.

If the visitor visa was only rejected because they did not believe he would return to Malaysia I don't see how this would affect the PMV. They are looking at whether you are a genuine couple intending to get married. The fact that he applied for a tourist visa does not negate that, in fact it only really suggests that you are trying to be together.

As Mish said, make sure you have good evidence put together before submitting your application.

Best of luck with your pregnancy!

Kind regards
