Passport name change after 309 submitted USA

Hi everyone.

Currently waiting on movement from a CO on a 309 visa.
I am the Aussie in the relationship, and we submitted our application January 2018. Hopefully getting pretty close to hearing something.

What has me spooked is the fact that we have not updated the Applicant's passport to reflect the name change. Currently we have the updated drivers license, social security card, bills etc, all in the new name. But the passport was never updated with the new name.

My question here is if we updated the name on the passport, color scanned it as updated evidence, do we also need to resubmit the application with the corrected name (also form 80) or will the CO look at the updated passport and match the two up.

The current application has the applicant's original name, as well as the updated name in the "other names known by" sections.

Just wondering if it is safer to leave things as is, and change the name AFTER we hear from a CO and get approval, or whether we should do it now. Just not sure what parts of the application to be updated if we go ahead with the name change.

Any help would be super appreciated! Thanks!

Changing the passport introduced an unnecessary complication.
Use form 929.

I changed my name on everything but my passport. I plan to in the future, but wasn't going to bother while in the partner visa process. Had no issues with getting the grant.

I never changed my name on my passport (which has now expired). I didn't change my name from an immigration perspective until I applied for citizenship. I simply attached a copy of my marriage certificate to connect the dots for why some documents had my married name and why some still had my previous name.

What a relief
Thanks so much for the answers!

We have her name changed on everything except the passport so we will leave that be until after we get through the process then. We'll just travel around with the marriage certificate as a backup haha.
