Please update your flag here .

Hi, we got contacted by CO through the immi account, 2 weeks ago, asking for more documents including the fbi background check that one of us can't go through with it, because is been living in the US undocumented. And it will flag the immi about the person and the location and might lead to deportation. Witch will break our family apart.

We already did the state police background check and came out clean and we already uploaded it with the application.

So we are looking for Mara agents in the USA who may know / have a precedent with this situation.
We found 2 located in New York. But I could not verify if they are legit. In their websites they don't disclose their Mara number.

Sandra Maxfield

The second one is for :
Jane Orgel Esq

Please help we were given 28 days to do so, we already burned half of it. We want to start a new life in australia and move on with our life.

You can check on the OMARA website (https://www.mara.gov.au/) to see if someone is a registered migration agent. Looks like Sandra Maxfield is registered but I don't find Jane Orgel.

You need the FBI check and if you've lived illegally in the US I hope you have already indicated this on your Australian visa application.

Yeah I did indicate that. And we used state background check and came clean. Would be the same with the fbi. Immigration lawyer here strongly advised me against it, given the current administration hard stance on immigration.
Is there anyway the CO will waive the fbi clearance? If yes, how?
Thank you.

This is something that you really need a good agent for. I highly doubt any of us would know what to do here. Being a US citizen, I fully understand your fear with your partner being an illegal in the US. However, I don't see a way around an FBI check, as it's standard. That being said, a RMA will know things the rest of us don't. There's a sticky on this forum with RMAs who regularly post on here. I'd highly recommend you contact one of them if you're unsure of US RMA credentials.

May I suggest that you consult one of the registered migration agents who posts on this forum? They have all managed US applications.

Thank you for the replies. They were helpful.
We reached out to a few lawyers and an MA too, still waiting for replies... Otherwise we are just going to go through with it.
