Partner Visa 309 or 820 Denial

Hello all! My partner and I are planning on applying for the 309 visa sometime in June, and I wanted to hear from people that have had either their 309 or 820 visas refused and why, as well as what you did after the fact (i.e. appeal, reapply, etc.).

I donít understand your approach. Why would your visa be refused? If you havenít lodged it yet, why not make sure you meet all requirements instead of worrying about a potential refusal?

I'm fairly confident in the strength of my application, I have looked up heaps of information on how to provide a decent application and I have read a lot of success stories, but I would also like to hear the flip-side of things and learn what to avoid and what problems other people have faced during their partner visa journey so I can avoid making the same mistakes.

I can't afford a consultation with a migration agent. My partner and I have to do this ourselves.

You are paying a $7160 visa application charge, plus ancillary costs, and you cannot afford a couple of hundred for professional advice to be sure you are on the right track?

Fair enough.

Partner visa applications are refused for a number of reasons. Here are some examples:

  • Incorrect information or documentation (even if provided inadvertently)
  • Health or character issues
  • Not actually meeting the relationship requirements
  • Insufficient evidence to show genuine relationship for the required timeframe
  • Previous visa history
  • Failure to respond on time to requests for further information
  • Inconsistent responses during interview
  • Inconsistent responses from witnesses

Depends on each case - often not a set time limit.

A complete Partner Visa application review, with a written recommendation service can be around $600. Not all RMA's offer this service. But is pretty good insurance on your $7,160 investment, and will cover most of the reasons the visas get refused. NB this is different to a consultation.

Thank you! I'll do my best to take this into account when preparing the application. By the time I apply I will have spent 21 months with my partner in Australia, so hopefully I will have enough documentation to prove that we are in a genuine relationship.
