Tourist VISA REFUSALS AUSTRALIA

Hi, I’m an aus resident and my husband is Indian. We applied for our spouse visa nearly 1 year ago. We have had 5 visitor visa refusals last one was last night and it is infuriating me that immigration can be refusing for the same thing each time- no incentive to return , a common refusal letter I’m sure. He shows family, family business lease agreements ect, all he could show but regardless of my stat dec or any documents provided they seem to insist he will not leave and it’s not for a genuine temporary stay. He has never been to Australia, great visa history elsewhere we have showed everything possible each time. One would think a partner visa is great proof that we would never jeopardise our future together but how do we build our strong history when I can’t drop everything and go back to India? How will this effect our spouse visa and how on earth can my husband show more honest incentive to return ? I just don’t know what they want from people! ☹️All we wanted was to be together for our anniversary. I’m on a work contract I can’t go back to India for another 5 months , these refusals are breaking our hearts. Please guys ... any advice so many are granted tourist visas why do they do this, so disappointed in the unfair presumptions.

Have you considered using a MARA agent to do this for you.

There must be something wrong somewhere.

I marry with aussi citizen girl on 7/12/17
And my file lodgment date is 16/2/18...

1) onece visitor refusal is before our marriage in 2017 (apply by agent)

2) after my marriage again we apply family visitor in march18 but they refuse (apply by agent)

3) again we apply for tourist visa With my wifes statutory declaration in april-18 they again refuse..( apply By self)

Reason is they think i will not go back to my home country

Its very hard to live alone...

Very long process time..

Its 16 months of file lodgement..

In order to satisfy visitor visa requirements, an applicant must be either employed(who receives salary through his/her bank account and not in cash), or a business owner(the business should be registered on its name along with taxation number, Pan card, a current bank account (in which the business transactions are done) and at least 3 years income tax return statements.

The immigration department has to make sure that the applicant fulfills either of the conditions before they can grant the visa.

No matters if the applicant has already applied for a partner visa, has 10-20 Lacs rupees sitting in its account (unless self employed/business person) and being sponsered by a spouse or a family member, who can show thousands of dollars in its account.

These things have got nothing to do with the tourist visa application. Hence, they keep giving the same reason of the purposed visit not being genuine.
Thus, if your partner can provide all the above documents and in your stat Dec, you mention that you take full responsibility and guarantee of the applicant that he will return back home before his visa expires, they may reconsider his application. I would even write that they could even strip off my sponsorship rights if the applicant failed to do so.

The harsh reality is that not everyone is entitled to a visa and that the Department can keep refusing tourist visa applications for no particular reason whatsoever. The "genuine visitor" requirement is pretty much a catch-all option for the case officer.

Given you have already received so many refusals, my advice would be to make an appointment with your local MP (not easy during an election) and ask them to assist you with a family sponsored vistor visa.

Keep in mind also that in the case of partner visa applicants, the case officer may take into consideration the likelihood of the partner visa being granted. If the partner visa application is not strong, they may be reluctant to grant a tourist visa. Not saying this is the case here. It is just a general observation.
