Wait 2 years to apply for 801?
 
Hi all,

Is it right that after a 820 is granted, you need to wait until the 24 month has passed since the initial application was made?

Is there circumstances where an 801 can be applied for earlier?

Once the 801 has been applied for, is it another 20 odd months that you can expect to get a decision, or is that amount of time taken from the initial application?

Just a bit confused on that, because it's not made 100 clear.

Eligibility date, to apply for the 801, is 24 months after the 820 application date.

Currently 75% of the 801's were finalised in under 20 months from 801 application eligibility and 10% took over 26 months.

Many are done in a lot less.
The last five 801 grants, that I have seen on the forum, have been: 7.5 months, 7.2 months, 26.6 months, 12.6 months and 10.9 months, from the date of 801 application eligibility.

If you were in a qualifying relationship for a least 3 years at the date of application, or 2 years with a child of the relationship, then if an 820 is granted the grant of an 801 follows automatically straight away. Some case officers do not send the 820, notwithstanding that it must be granted before an 801 is granted. This might be to stop applicants who think they have been dudded running around in circles, tearing their hair out and sending abusive emails.
