Urgent help needed " visa refused due to points defection"

Hi all,
Our visa application got refused due to points deduction . When we lodged our Eoi early 2018, we had 70 points. In August 2018 the points dropped to 65 due to age factor. We got an email mentioning the drop of points to 65.
We got an invitation sometime in January 2019. We lodged the application in February.
The refusal state that in January our point was 70 and in June we were given 65 point.

From our research, the cut off points for 189 is 65. Are we wrong?

There might be too many 'should have' , but we'd really prefer suggestions for solution.
What should we do?
Please help!

Hi Dalel,

If you are 100% sure the points dropped in August, and that you claimed the create number of points with all documents to proof it, you should appeal to the AAT.

I would not want to express an opinion without seeing both the invitation letter, the lodged application and the refusal letter.

Your situation makes no sense. If your points dropped due to your age, the system updates automatically and your invitation would be based on the reduced points. However if you have claimed points that were later discounted during your application processing (for example you claimed experience points that DHA decided are not eligible), then that would be a valid reason for the refusal.

I'd suggest you carefully review your application and the refusal letter, and if you still have questions then speak with a registered migration agent so they can go over the documents with you.

I agree with this assessment. It really is impossible to say anything sensible about this without reviewing all the relevant material. When I read actual decision letters the reasons for refusal often differ wildly from what the visa applicant initially told me.

Just 5 points due to age. Something so small... I mean 65 is the total point needed even with the age point reduction. Was an oversight, as Maggie-May24 said, the points should have been adjusted automatically 😞.... I don't know if we can appeal the decision as we still have 65 point?

The decision letter will state if there is right of merits review for the refusal. If you are offshore then you can't appeal.

We are offshore, so what should we do now?
