Unable to attain Criminal Record check

Hi all,

I'm the Australian partner who will be sponsoring my spouse with a Partner Visa 820. I have spent more than 12 months cumulative in his home country (Mexico) on a visitor visa (legally).

Mexico does not give federal police checks/criminal record checks or the like to people who have been on a tourist visa. You need to be, at minimum, on a temporary resident visa (which i never was).

Does anyone have advice for what to do in this situation? I have no criminal past, but I am unable to provide a criminal check from a country that I have spent more than 12 months in over the past decade.

Any help would be appreciated! Thank you

I cut and paste from the immigration website below. Looks like Aus immigration believes there is a process for non-citizen and non-resident - but requires that you nominate a person with power of attorney to go in person with your translated and apostilled documents to apply for you.

Police check - Mexico
Client residents: Apply in person for a penal clearance to the National Safety Commission (CNS).

Required documents:

Acta de nacimiento (Birth Certificate)
Official ID - Mexican driver licence, passport or Credencial de Elector (Mexican Voter’s card).
Non-citizen residents: Apply in person for a penal clearance to the National Safety Commission (CNS).

Required documents:

Original birth certificate.
Birth certificate must be apostilled and translated into Spanish by an official translator.
Mexico's Multiple Immigration Form (FMM) or Mexican visa (FM1/FM2/FM3).
Only if the client is currently residing in Mexico.
This process is free and completed on the spot within 20-30 mins, however, if there are special circumstances the client will need to wait 10 days to receive a penal clearance.

Citizen non-residents: Can appoint a power of attorney to someone to apply in person to CNS.

Required documents:

Birth certificate (Acta de nacimiento)
Power of Attorney (Carta poder simple)
Official ID - Mexican driver licence, passport or Credencial de Elector (Mexican voter's card).
Non-citizen non-residents: Can appoint a Power of Attorney to someone to apply in person to CNS.

Required documents:

Original birth certificate *Birth certificate must be apostilled and translated into Spanish by an official translator
Power of Attorney (Carta poder simple).
Processing time: Generally takes 2-3 weeks to process this request once all the required documents are submitted.

Step 1 would be to obtain an officlal confirmation of your claim about PCC unavailability from Mexican authorities or a local attorney. Depending on your circumstaces there are other steps you might take. May I suggest that you consult a registered migration agent for futher advice?
