Question Moving from pmv 300 to partner visa 820

Hi guys,
I need some advice from you, please.
1. We applied for a PMV (visa 300) in April 2019*
2. My fiancee came to Australia two times (May 2019*and August 2019)*on a one-year multi-entry tourist visa.
3. We got married in Australia at the end of October 2019.

My questions:
1. We got married in Australia, is it still legal if we move from 300 to 309 or we need to withdraw and re-apply the new visa 820? By doing this way, it costs us another AUD7,715.
2. If we go from 300 to 309, do they reset the current waiting time and our application will go to the bottom of the visa 309 waiting list?
3. How long does it normally take to wait to apply and get the visa 309 compared to apply and get the visa 820?
4. Which way should we go, applying visa 820 or visa 309? What the benefits of going that way compared to the other?

From what you have posted, you no longer qualify for a 300 visa and your best strategy might be to notify immigration that you are married, withdraw the 300 and proceed with a 309.

This is not a considered professional opinion.

May I suggest that you consult one of the registered migration agents who posts on this forum for advice about strategy?

If you change to the 820, it would be a new application, with a full application fee again. Not the best option regarding cost.

Switching to the 309 sounds common in your situation.

Not exactly sure what the technicalities of it are, but it seems that once you notify Immigration of the marriage, your application gets switched to the 309, from application date.

The 309 requirements are higher than for a 300, so a rejection could become more likely. This depends on your relationship proofs.

And of course you still need to leave Australia to activate the 309 though.
