Question Hello looking for advise for partner

Hi everyone,

I'm Cecilia, Australian citizen from 2016, and looking for advice for my now partner that is in a very tricky situation.

We've been friends since 2017, and I've seen and lived his Visa issues very closely.

He arrived in 2012 with WHV, then about a year later changed it to a Student in that he cancelled in 2016 as he was in a relationship (since 2011) with an Aussie (not me). He cancelled the student to do a defacto, but he changed his mind as he wasn't sure, and he had no choice than to leave the country... came back in 2016, still in relationship with her, (living together) with tourist, then found a sponsor 457 Visa in 2017 that has been withdrawn by the shop as he changed ABN and couldn't' / dint' want to sponsor him anymore as he had all the receipt he needed and no longer needed him. So he went back tot Italy again as he had no choice. Came back in Feb 2019 on Tourist .. applied in May the Partner Visa but she cheated on him 2 weeks later.
He moved in with me as a friend ( ( i must admit i always liked him) .. tried to make things work with her.. she went holiday for about 2 months, come back and she sent the letter to immigration to communicate the relationship was over (Aug 2019) in the meantime we got closer and closer.. now, after 5 months we are started dating.. (still leaving together) - about 2 weeks ago he received the letter from immigration to confirm withdraw. We have an appointment with Immi Layer next week, as during Xmas it was hard to find one. But i would like to be prepared before we go. We saw on Immi Layer in August already, but we only wasted our money as we didn't get an advice on which action to take, and i contact the lawyers again to see if they could give me more advice but asked me $500 for the same consultancy. definitely don't want him to leave but we have to see our chances.

I was wondering if:
- he can apply an onshore tourist visa to buy time
- in the mean time we are looking at the possibility to apply for a Skilled visa which we haven't been advised before but from the home-affairs website he seems to be qualified. is a pastrycook with over 20 year experience in Italy.
- apply for partner after the Tourist Visa

Was your lawyer a registered migration agent?

Do not rely on information found on immigration websites. Unless you research thoroughly you might easily be misled by incomplete information.

Given the visa history you have described, I do not like the chances of satisfying the 'genuine visitor' requirement.
