Police check for citizenship application

Hi,

On the general eligibility requirements for Australian Citizenship it states:

The following requirements apply to the period of time you have held a permanent Australian visa.

You need an overseas penal clearance certificate if:

you lived or travelled overseas since the age of 18 years, and
the total time you spent overseas adds up to 12 months or more, and
the total time you spent in one country adds up to 90 days or more.
Does this imply that you will only need penal clearances from countries you visited since the grant of a permanent Visa? i.e. before the permanent visa was granted, any travels to foreign countries is irrelevant and no police check will be required for these countries?

I may be presuming here but I would say that yes, that is correct, from the date of your PR.

The requirements are slightly different if you are becoming a citizen by descent, adoption, resumption - they require it for the last 10 years.

From the date of your PR visa, and only travel for the time you held a PR visa, according to the 2nd bullet point, and only if you have spent over 12 months outside Australia, according to the 3rd bullet point, and, only for countries where you spent more than 90 days.

Form 1300T
When to provide overseas penal clearance certificates Penal clearance certificates from overseas countries are required if:
you lived or travelled outside Australia since the age of 18 years or over, and
you held a permanent Australian visa at that time, and
the total time spent outside Australia added up to 12 months or more, and
the time spent in any one country was more than 90 days,
or
requested by the Department.
You will need to provide original overseas penal clearance certificates from each country where you spent more than 90 days.
