Visa 186 Direct Entry - Query

Hi There,

I have question around the condition - "have at least 3 years relevant work experience, unless you are exempt" when applying for Employer Nomination Scheme visa (subclass 186) -Direct Entry stream.

I satisfy all the conditions but not sure on the above.

I am working in IT as business analyst since day 1 of my employment but did my engineering in mechanical engineer due to which ACS deducted 6 years experience.

Total work experience -7.5 years (4.5 years in Australia on visa 457/482)

ACS skill assessment was positive stating -

"Your skills have been assessed to be suitable for migration on under 261111 (ICT Business Analysts) of the ANZSCO Code. The following employment after April 2018 is considered to equate to work at an appropriately skilled level and relevant to 261111 (ICT Business Analysts) of the ANZSCO Code."
Dates: 04/12 - 07/15 - 3 year(s) 3 month(s)
Position: Consultant
Country: India

Dates: 07/15 - 10/18 - 3 year(s) 3 month(s)
Position: Consultant
Employer: XXXX
Country: Australia

If i reduce 6 years , i am left with hardly 2 years experience. My employer is a small company and ready to sponsor.

What is your current immigration status and how long have you held your current visa?

I have been staying and working on visa 457 for 4 years beginning July,2015. Thereafter i switched my job and my new company sponsored my visa 457.

Last year when my visa 457 expired (it had 4 years validity), my company sponsored me on visa 482 as visa 457 was abolished. I am currently on visa 482 - starting July,2019.

Visa 457 : July 2015 - July 2019
Visa 482 :July 2019 - till date

How long have you been employed by your current employer on either a 457 or a 482?

On a 457 you would have qualified for DE after 2 years.
Having changed employer, you will now need 3 years.
It might pay you to consult one of the registered migration agents who posts on this forum for an assessment of your visa prospects.

Thank you for your time to respond back. Much appreciated.
I did hired a MARA agent to assist me filing my visa application last year. That's another story, they have been of no assistance.

I am sorry but what you mentioned is the requirement for Temporary Residence Transition stream. The Direct Entry stream conditions on the immigration website states:

You must
have an occupation that is on the list of eligible skilled occupations
have at least 3 years relevant work experience, unless you are exempt
have a positive skills assessment, unless you are exempt.

My query here is around this - " 3 years relevant work experience". Below is my ACS assessment:

Your skills have been assessed to be suitable for migration under 261111 (ICT Business Analysts) of the ANZSCO Code.

The following employment after April 2018 is considered to equate to work at an appropriately skilled level and relevant to 261111 (ICT Business Analysts) of the ANZSCO Code.
Dates: 04/12 - 07/15 - 3 year(s) 3 month(s)
Posi_on: Consultant
Employer: XXXXXX
Country: India

Dates: 07/15 - 10/18 - 3 year(s) 3 month(s)
Posi_on: Consultant
Employer: XXXXX
Country: Australia

If you are interested in applying for a skilled independent, DE, or state/territory nominated visa please go to my website pinoyau.com and I shall have a look at your case, if you wish.

Thank you for your quick response. I will be more than happy to have you onboard.

My only concern as of now is - do i satisfy the condition under the specific question for which i believe, i have provided more than enough details .

Once you advise on the specific question raised , i will more than happy to seek your service further to determine the other eligibility to apply for the PR under this stream. i am not worried about the fees if they are as per the standard market rates.
