TSS Visa 482 Experience Requirement

Hello,

I know there is a 2 years experience requirement for the TSS (undertaken in the last 5 years), but the way this experience is accounted is quite unclear to me (e.g. Is pro-rata applied or is there a minimum number of hours for an experience to be accounted? If pro-rata, on what basis? Also, is a full-time internship taken into account?). I also know I don't need a skill assessment.

My situation:
- Bachelors (ICT Major)
- Masters in Computer Science, including 1 year full-time internship, 1 year part-time remote work
- less than a year full-time work

I am now working with reduced hours so I need to know how my ongoing experience is accounted in order to understand when I will comply with this visa requirement.

Thank you for your answer. I understand an RMA is of essential importance to successfully prepare and lodge a visa application but at this stage, I would just like to understand better one requirement.

It does not seem like a complicated question and I am very surprised I cannot find any clear answer. Either there is a clear rule establishing how work experience is accounted, or I guess it depends on the application reviewer's mood.

Hi Kookaburra -

Previous work experience to meet the 2-year requirements is generally required to be within the last 5 years, and for 35+ hours/week - the definition of skilled work being 20+ hours a week as applies for points tested work experience doesn't apply here. That being said, DHA has a considerably larger area of flexibility for the work experience for this visa as compared to some others, and in some cases on a case-by-case basis will consider work while a person was completing their qualification and other sorts of other non-traditional work experience. So it's not necessarily a black and white question with a fixed definition in this case, but hope this additional info helps.

Thank you Mark, it is a bit clearer to me. Is there any flexibility regarding the number of hours/week? Considering I am now working 30 hours a week, is none of my work experience going to be accounted from now on? That is my main concern.

Hi Kookaburra -

Yes, there is some flexibility based on the characteristics of the job. Here's some DHA policy that may be helpful:

Under policy, it is expected that the work experience should have been undertaken on a full-time basis in the last five years. This period does not need to be continuous. Decision-makers may also consider work undertaken as a part-time employee that is equivalent to two years full-time, where they are confident that the applicant’s experience and skills are relevant and current.

Consistent with the National Employment Standards (NES), employment will be considered ‘full-time’ where the visa applicant worked 38 hours per week.
Work experience will, however, also be considered ‘full-time’ where the visa applicant worked for a period between 32 and 45 hours per week under an industry award or an agreement that was consistent with the NES where applicable.
Decision-makers should also be aware that there are a variety of prevailing work arrangements in the Australian labour market that do not adhere to a standard work week and contact Program Management if they require further advice.
