Dual citizenship different DOB

Hi All,
I'm trying to apply for 190 visa, currently on-shore. My son has dual citizenship. On the first passport where he born, his birthday is 10 June 2010 which match his birth certificate. The second passport is based on the translated copy of the birth certificate, the translated copy is done by the officials in my country and they mistakenly translated it to 10 July 2010 and his passport have this DOB. Now fixing that would require a court and be physically present in my country. We entered Australia based on his second passport (the one with wrong DOB) because we applied from his second country.
My Question if I provide all the facts (both passports, both birth certificates, and affidavit) would that be enough for the case officer. Any insights are very useful.

Hi there,

I do not have an answer to that as it is not straight forward. However, I agree with the idea of submitting a very detailed Statutory Declaration explaining the situation, including the steps you will need to follow to correct the mistake and the reasons why you are unable to proceed at this time (even if Covid-19 is the obvious reason). Any evidence that you can attach to prove that it was just a mistake would be useful.

Maybe other agents in this forum can answer your question based on their personal experience.

Be very careful.
There was a case where an applicant had a birth certificate with an error. She lodged it with an explanation that a corrected certificate would be submitted when available. She was refused a visa, for having lodged a fraudulent document. It might pay you to consult the registered migratrion agent who managed this case and won in the finish;
