2nd Sponsorship Questions!

Hi everyone.

My situation is that me and my partner got married in 2018, we submitted my wifes application for a partner visa and i submitted my application to be her sponsor, my wife was already staying in Australia at the time.

Mid last year our marriage broke down and we separated before she had a result on her visa application, and because of the separation i withdraw my application to be her sponsor. This year she has had her visa approved on other grounds.

If i was to meet someone else overseas sometime in the next few years and would like to try again, i have read that once i have sponsored someone that i'm only allowed to sponsor a 2nd person and no more after that.

Also i read that i would not be allowed to sponsor someone again until 5yrs from the date i had applied for sponsorship for my ex wife the first time.

But technically i did not end up sponsoring my wife because i withdraw as her sponsor last year well before her visa was processed and approved this year.

My questions are-

So even though i withdraw as sponsor and was not her sponsor in the end, does that mean that it was still counted as using 1 out of the 2 sponsorship limit, simply because i had applied as a sponsor in the first place?

And because i did not end up being her sponsor despite initially submitting my sponsorship application into immi, do i still have to wait 5yrs before i can sponsor someone else?

What might happen would depend on the full circumstances of your case.

Sponsor approval first maybe a issue for your future applications - not many other grounds to have the Partner Visa approved.

Hi and thank you.

Is there any way of finding out for sure, would immigration tell me if i contacted them about whether my first sponsorship was counted despite me withdrawing it?

Thanks, what would be the issue with a future sponsor application that your referring to, the fact that i had tried to sponsor my ex wife despite me withdrawing it in the past?

If you contact immigration whatever they tell you will stand a good chance of being wrong and you will still not know where you stand.

Once the relationship has broken down and you withdrew your sponsorship for that application - to have the Partner Visa/s then granted to your ex wife, the only way is to prove Domestic Violence.

The new law that has the sponsor approved before the Partner Visa can be lodged is to protect/prevent victims of Domestic Violence. This new law has been passed but DIBP have not implemented the official process yet.
