Hi everyone,

I’m currently on the 820 visa which was granted in 2018, awaiting the 801. Unfortunately last year my sponsor left me for a Canadian woman before we had a chance to submit our evidence for the second stage.

I didn’t submit anything on advice from my lawyer and waited months. Just yesterday I received an s57 notice from immigration saying I had 28 days to respond to unfavourable information about my visa (my ex had emigrated to Canada with the woman and immigration had investigated it and determined we aren’t together). Since then I have decided to return to my home country, so my lawyer advised that I withdraw the visa within the 28 days and I will then be given 35 days to leave once immigration acknowledge my withdrawal

So my question is on average how long do the withdrawals take for partner visas after receiving the s57? I know I Have at least 63 days (28 days + 35) until I have to leave, but how long are the waiting times once the withdrawal is submitted? Days? Weeks? Months?

Just so I have an idea of how long roughly I will have left here. I’ve lived in Australia for almost 5 years, so I have quite a lot of stuff to organise before I leave and don’t want to leave it til the last minute.

If your lawyer is a migration agent, they will be the best source of this information. However it's usually a "how long is a piece of string" matter when asking anything regarding immigration decisions. Your safest bet would be to assume they acknowledge it the day you submit it and any extra time is simply a bonus.
