Exclamation 485 applications with Covid

Hi,
My student visa expired (on 30 september 2020) and I am on a BVE right now.
I am planning to go back to India by next week (23rd october 2020).
Can I apply for 485 (post study work stream) offshore at all due to covid temporary changes? Do I still need a valid visa to apply from offshore?
I tried to apply through immiaccount and it is not letting me through.

Do you actually want to go to India?
If your visa had expired less than 28 days ago you can apply for a few types of substantive visas including another student visa or visitors visa etc

I do not want to go to India and I really want to stay in Australia since I already have a graduate job.
But since I already I applied for bridging visa E, I cannot apply for 485 visa or further student visa.

I’d say apply for a visitors visa using form 1419 and submit via paper/postal service. After the grant apply for a 485 immediately. Catch is you can apply 485 only within 6 months of graduating/last student visa held, so looks like you can achieve it.

In visitors visa application you can be genuine about your recklessness I.e, leaving the student visa to expire and that now you want to gain a substantial visa to apply for a 485 visa or.. change the story and say you want to wait it out till commercial flights resume and after the grant, in 485, mention change of plans due to job offer.

I would suggest first option coz second option isn’t really necessary when you already have BVE for same purpose.

I’m no lawyer or consultant so please discuss this option with any qualified person

Definitely not coz 485 CO will understand the applicants intentions as non genuine per previous 600 application if lodged & granted. But I can’t think of any better solution for OP to stay onshore than leaving Australia.

Or maybe get a 3 month visitor grant and then get 485 lodged later - in third month which is a couple weeks before expiry of 600, citing change of circumstances?

At this point, I just want to go back to India and decide (just to have a clean record and have no visas rejected).

But I am confused if I can even apply 485 offshore based on the concession made by the government last month. I talked to many agents and lawyers and they are confused too.

It sucks because I will lose my dream job and be stuck in India just because I was misadvised by my agent. I will probably have to enroll for another degree, get my student visa again, complete the degree and then apply for 485.
