101 Dependant Child Visa - does application need to be finalised before she turns 18?

Good afternoon all,

My British partner and I are now on the other side of the very lonnnnng 820/801 Visa journey complete with BVE's and all that fun.

We are now looking at sponsoring my step daughter (my partners biological daughter) on a 101 Visa. She is currently 17. We have left it as long as possible so as to give her as much time as possible to decide whether to live with us in Australia, or remain with her mum in the UK.

My question is, does her visa need to be approved before she turns 18, or does it just need to be lodged a reasonable amount of time before she is 18?

Also, she is considering taking up an apprenticeship. This would not provide her with the means to support herself, but would it hinder her chances of being approved for her Visa?

I am an Australian Citizen by birth, and my husband is a Permanent Resident.

May I suggest that before you commit to a course of action, you consult one of the registered migration agents who posts on this forum for advice about strategy?

Thank you Westly, I was hoping the answer would be fairly straightforward. Is there particular strategy required for this type of visa, are they regularly refused?

I have never had one refused, but child applications are sitting there for ages. You are almost certsinly better off trying to get your child onshore before applying. If you want me to advise, please go to my website pinoyau.com and use the contact form.
