Part provisional visa 309/100

Gday everone, I got quick question in regards to paid paternal leave for my wife. My wife arrived in Australia on 26th nov 2018 on subclass 309 and she got her subclass 100 approved on may 2020. We are expecting a baby in jan 2021 and I was wondering if she’s eligible for paid paternal leave?. She qualifies for job test period. Any help in regards would be helpful.

Yes, your wife is eligible to get a paid paternal leave; however, there are certain requirements that need to be met prior to availing the benefits of the paid paternal leave. Also, you need to get your child’s birth registered via birth registry.

Hi Gary,
this link may help you with your question on paid parental leave
dss.gov.au/sites/default/files/documents/03_2013/ppl_factsheet_2_parent_eligibility_0.pdf[/url]
- sorry you will need to cut and paste that link.

I notice that your wife got her permanent (100) visa in less than two years after getting the provisional 309 visa. Can I ask what the process was to progress from the 309 to the 100 visa? Were you asked at a certain time to submit more information?
My wife currently has 309 visa and it will be two years come January.
Thanks

You are eligible to apply for the 2nd stage 100 2 years after applying for the 309....not 2 years after grant
From what you posted it seems you were eligible to apply some time ago

Thanks for your reply Sammy.
We submitted for 309/100 visa on Jan 9, 2019 and it was granted on March 21, 2019. Does this mean I will be able to upload more evidence during December this year? (Jan 9, 2021 being two years since application was made). I am wondering if I should receive an email informing me to take the next step or I just login to my immi account and start uploading?

Thanks
Ben

You can apply for 2nd stage 1 month before eligibily so Dec 9.
Theres a lot more to it than just uploading evidence. You need to make a new application for Stage 2
