Employer Sponsord Visa (Subclass 457)

Hello,

Can somebody tell me what the employer needs to do befor I can apply for a Employer sponsord visa (subclass 457). With the new regulations introduced this year, it seems to have become much harder for employers, because they have to prove that there are no other Australians with equivalent skills than the overseas person.

How do they actually have to prove that the overseas person has better qualified?

Would be great if somebody would help me, because I found somebody willing to sponsor me, but they are very conserned about proving to the immigration office that I am the most qualified person they found for the job.

Hi Apfelatrudel,

I'm not an immigration agent and do not research Visa changes too deeply but we do get a couple of IAs who go to our Visas & Immigration section and I'll move your post there to see if an IA wants to comment.

From my own perspective though, there have been some changes made to the 457 visa as you're aware of and they're as much to tighten up re employers paying market rates and having proper agreements re employees they sponsor as anything else.

It has always been a requirement that employers have to register and then get approval for a nominated position and meet certain requirements in doing so including showing that they have not been able to attract suitable eligible employees.
How they do that is probably showing at minimum that they have advertised a vacancy and in the current economic climate, I'd expect that the onus on an employer to show the need to sponsor people is somewhat higher.

If you and an employer wish to take a DIY approach, both of you need to examine closely all the DIAC site information and make yourselves aware of what needs to happen.
The application cost is not all that high and the worst an employer and yourself can achieve is a No and it may not be that straight off but further information sought by DIAC.

Hi Apfelatrudel,

The 457 program has undergone extensive changes this year with a major overhaul introduced in September.

The company will need to lodge a sponsorship application to show that they meet all of the criteria to sponsor overseas workers and a nomination application for the position to be filled.

There is no requirement to show that the company has tried to fill the position locally or that the overseas person is better qualified.
Due to the extensive changes there is much confusion about what the requirements are and as of late I have seen an increase in companies getting it wrong.

My advice would be for the company to do extensive research on the process to make sure that they have a good chance of success.

Stating that a company needs to show that they cannot get suitable employees is a bit strong but they are supposed to attest to a policy of employing local labour.

need help too

hello im new to the forum and cant post my message dont know why , can somebody tell me where to go on the site

well im like in a similar position , have been in sydney for 2 years , did a certificate iv and diploma in business management thats my highest qualification, my student visa will expire in april 2011, since november 2010 ive been working as store person/forcklift driver in a logistic company , may be they will sponsor me to work full time , just want to know if thats possible through the 457 visa or other , if i get a positive answer from the company. im confuse and worried of my skills and other processes , assessment and skills in demand like how they shud prove that im qualified than other australian , and i have one year experience as storeperson in my country and other certificates in computer

if anyone could give some advice, or shud i extend my student visa again ,ideas would be great

You'll not be able to be sponsored as a F/L driver or a storeman and you ought to first have a look at the position eligibility in the Immi 457 visa section and you'll find a link to occupations for which sponsorship is possible.
You'll find all the eligibility requirements there too.

For opening your own thread, you'll see at the top of a section page a tab at left top for New Thread.
